ORDINANCE NO. 18817-09-2009 AN ORDINANCE AMENDING THE FORT WORTH FIRE CODE, CITY CODE CHAPTER 13, PROVIDING FOR CERTAIN FEE AMENDMENTS; PROVIDING PEN- ALTIES FOR THE VIOLATION THEREOF; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING FOR SEVERABILITY; PROVIDING FOR A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PRO- VIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS the City Council adopted the 2003 International Fire Code with Ordinance 16027, which was further amended by ordinances 16252, 17390, and 1 8443-0 1-2009 (collectively, the `"Fire Code"}; WHEREAS the City of Fort North is increasing certain Fire Department fees provided for in the Fire Code; WHEREAS, the Fire Code is being amended to reflect said fee increases as set forth herein. BE IT HEREBY ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. SECTION 5. Appendix J, MANUFACTURED Ht~ME AND RECREATIONAL VEI-IICLE PARKS, J401. L I Calculation of Inspection Fee is hereby amended to read as follows: J401.1.1 Calculation of inspection fee. The annual inspection fee for inspections re- quired by this section are calculated as the total of the following: a. Base fee of $150.00. b. Additional fee of $5.00 per individual lot within the park. SECTION 6. Any person, firm, or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not to exceed Two Thousand Dollars ($2,000.00) for all violations involving fire safety, or public health and sanitation and shall be fined not more than Five Hundred Dollars 0500.00) for all other violations of this ordinance. Each day or any portion thereof during which any violation of this ordinance occurs or continues shall be deemed a separate offense and upon conviction thereof shall be punishable as herein provided. SECTION '7. Page 5 This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provision of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Cade are hereby repealed. SECTION $, That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sen- tence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such voidness, in- effectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council, without the incorporation herein of any such void, ineffective or unconstitu- tional phrase, clause, sentence, paragraph or section. SECTION 9. All rights and remedies of the City of Fort Worth, Texas are expressly saved as to any and all violations of the previous Fire Code, or any other ordinances affecting construction and fire safety, which have accrued at the time of the effective date of this ordinance: and, as to such ac- crued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but maybe prosecuted until final disposition by the courts. SECTION 10. The Fire Department of the City of Fort Worth, Texas, is hereby authorized to publish this ordi- nance in pamphlet form for general distribution among the public, and the operative provisions of this ordinance as so published shall be admissible in evidence in all courts without further proof than the production thereof, as provided in Chapter X~V, Section 3, of the Charter of the City of Fort Worth, Texas. SECTION ll. The City Secretary of the City of Fort Worth, is hereby directed to publish the caption and Sec- tions 1, 2, 3, 4, and 5 of this ordinance for two {2) days in the official newspaper of the City of Fort Worth, Texas as authorized by Section 2, Chapter XXV of the Charter of the City of Fort Worth, Texas and by Section 52.013 {a) of the Texas Local Government Code. This includes Section H104, Fees for Inspections and Operational Permits, Section 1102, Fees for Fire Protection Systems and Equipment and Section J401, Fees for Inspections of Manufactured Home and Recreational Vehicle Parks. DISCUSSION: _ __ The proposed changes were discussed at the August 21, 2009, Gity Council budget session, and are included as revenue in the 2009-2010 Proposed Budget. The last fee increase occurred in 2003; the current fee increases will cover the increase in fuel cost, vehicle costs, and personnel costs. The following is a description of the proposed changes: tnspeetion Fees for Commercial Structures Commercial Structures within the City of Fort Worth are inspected annually to ensure compliance with the Fire Code. Fees are set based upon the square footage of the structure. Fees for Operational Permits These fees are for permits issued to businesses having special requirements such as welding, public assembly, paint booths, high-staked materials, etc. that due to the nature of their businesses could pose fire hazards. Fees for Permits for Fire Protection Systems and Equipment Permits are issued for the installation of fire protection systems and equipment in new structures and/or changes or upgrades to existing systems. Fees for the permits are based upon the number and types of devices per structure.
