„~,, AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND
` EXTINGUISHING A PORTION OF A UTILITY EASEMENT;
PROVIDING FOR REVERSION OF FEE IN SAID LAND(S),
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT THE east 2--1/2 feet of the 7-1/2 feet wide utility
easement located along the rear property line of Lot 44, Block E,
Section 3, Cook's Meadaw Addition, as recorded in Volume 388-111,
Page 29, P.R.T.C.T,, and as more specifically described in
attached Exhibit A, attached hereto and incorporate herein be
and the same is vacated, abandoned, and permanently closed and
extinguished
SECTION 2.
That the fee to the land(s) in the above described vacated
portion of the utility easement is hereby released and shall
revert to the adjacent owner(s) as provided by iaw
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force
and effect from and after the date of its passage, and it is so
ordained.

~e UTILITY EASEMENT TO BE VACATED
-Being a portion of an existing 7.5' wide, utility easement across Lot 44,
Block E, COOKES MEADOW, SECTION THREE, to the City of Fort Worth, Tarrant
County, Texas, according to the plat thereof recorded in Volume 388-111,
Page 29, Plat Records, Tarrant County, Texas. Said portion being more
particularly described by metes and bounds as follows:
Beginning at a point in the North right-of-way line of Brentwood Stair
Road, said point lying North 89 degrees 44 minutes 38 seconds East, 5.03
feet from the Southwest corner of said Lot 44, Block E;
THENCE North 05 degrees 48 minutes 38 seconds East along a line 5.0 feet
East of and parallel to the West line of said Lot 44, a distance of 115.19
feet to a point in the North line of said Lot 44;
THENCE South 78 degrees 07 minutes 22 seconds East, 2.51 feet along the
North line of said Lot 44 to a point in the East line of the aforesaid 7.5'
utility easement;
THENCE South 05 degrees 48 minutes 38 seconds West, along the East line of
said 7.5' utility easement and along a line 7.5' East of and parallel to
the West line of said Lot 44, a distance of 114.66 feet to a point in the
aforesaid North right-of-way line of Brentwood Stair Road;
THENCE South 89 degrees 44 minutes 38 seconds West, 2.51 feet along said
North right-of-way line to the Place of Beginning and containing 287 -square
feet of land.

RECOMMENDATION:
It is recommended that the City Council adopt an ordinance vacating the
east 2-1/2' of a 7-1/2' wide utility easement located along the rear
property line of Lot 44, Block E, Section 3, Cook's Meadow Addition, as
recorded in Volume 388-111, Page 29, P.R.T.C.T.
DISCUSSION:
Security One Federal Credit Union, owner of the subject property, has
requested that the City vacate the above-described portion of the utility
easement as delineated on the attached map and field notes.
The subject portion of the easement, acquired by dedication, is platted but
does not contain any utility facilities. The subject vacation is made in
order to utilize the vacated easement as part of the development of the
subject property for a swimming pool.
The Director of Real Property Management has determined that a $1.00 con-
sideration fee satisfies the City of Fort Worth's interest in this request.
Reviewing City departments and private utility companies have raised no
objection to this request.
