ORDINANCE NO.
AN ORDINANCE AMENDING THE BUILDING CODE OF THE CITY OF
FORT WORTH, CODIFIED AS CHAPTER 7, ARTICLE III, OF THE
CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED, BY
AMENDING SECTION 125 OF THE APPENDIX, CHAPTER I,
DIVISION II; BY AMENDING SECTION 104 BY ADDING A
SENTENCE TO SUBSECTION (d); BY AMENDING SECTION 1709(x)
EXCEPTION NO. 2; BY ADDING A SECTION 1215 TO
CHAPTER 12; BY AMENDING SECTION 301(b)(1); BY ADDING A
SECTION 514 TO CHAPTER 5; AND BY AMENDING
SECTION 4607(4) TO INCREASE THE FEES FOR PERMANENT
ENCROACHMENTS; BY AMENDING SECTION 3801(4) EXCEPTION 3;
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS
CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM;
PROVIDING FOR A PENALTY; PROVIDING FOR PUBLICATION IN
THE OFFICIAL NEWSPAPER; PROVIDING FOR ENGROSSMENT AND
ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That Section 12S of Appendix, Chapter 1, Division II,
entitled "Life Safety Requirements for Existing High-Rise
Buildings," is hereby amended by adding a subsection (c)
entitled, "Basement Access or Sprinkler Protection," to read as
follows:
"(c) Basement Access or Sprinkler Protection.
An approved automatic sprinkler system shall be
provided in basements or stories exceeding 1,500 square
feet in area and not having a minimum of 20 square feet
of opening entirely above the adjoining ground level in
each SO lineal feet or fraction thereof of exterior
wall on at least one side of the building. Openings
shall have a minimum clear dimension of 30 inches. If
any portion of a basement is located more than 75 feet
from required openings, the basement shall be provided
with an approved automatic sprinkler system through-
out."

SECTION 2.
That Section 7-47 of the Code of the City of Fort Worth
(1986), as amended, is hereby amended by adding the following to
Section 104(d) entitled, "Maintenance":
"...Any material such as masonry, concrete, steel,
wood, plastics, glass, gypsum products, plaster, stucco
and other construction materials, when placed upon a
structure or building, shall be kept in repair and
shall be replaced when not painted or preserved for
either fire protection or weathering purposes and
further shall be replaced or repaired when broken,
deteriorated or unsafe."
EXCEPTION: White wood or natural decay resistant wood
fences provided for screening purposes only and not
required by other codes or ordinances may remain
unpainted or untreated provided that the fence is kept
repaired and in a safe condition."
SECTION 3
That Section 7-47 of the Code of the City of Fort Worth
(1986), as amended, is hereby amended by amending
Section 1709(a), General, Exceptions: 2", to read as follows:
2 Walls which terminate at roofs of not less than
two-hour fire resistive construction or roofs con-
structed entirely of noncombustible materials."
SECTION 4.
That Section 7-47 of the Code of the City of Fort Worth
(1986), as amended, is hereby amended by adding the following
Section 1215 to Chapter 12, Requirements for Group R Occupancies,
to read as follows:
"Security requirements - Two-Family Residences and
Apartments.
Section 1215. No two-family residence or apartment
building shall hereafter be erected without those
security requirements set out below. Such
installations shall be installed on all exterior doors
and any door leading into a dwelling unit from a public
corridor.

1 Hinges shall be installed so that the butt of the
hinge is inside the dwelling unit or structure;
2. Side glass panels shall be spaced a distance of
three feet from the door or be constructed of
shatter-proof construction when located closer
than three feet;
3. Doors shall be of solid core wood construction of
1-3/4" or hollow metal;
4. Doors shall contain a fish-eye viewing lens;
5. Sash and jamb shall be reinforced with blocking
between studs and jamb at locking device;
6. Dead bolts with a 1-inch throw are required and
shall also meet Sections 3304(c), (d), or (e) of
this Code;
7. Strike plates for locks shall be held i.n place
with a minimum 1-1/2-inch No 6 screw;
8. Glass patio doors shall be drilled through the
overlapping frames so that a bolt or pin may be
inserted to provide a positive latch. Such hole
shall be drilled in the top corner of each panel
where such panels overlap "
SECTION 5.
That Section 7-47 of the Code of the City of Fort Worth
(1986), as amended, is hereby amended by amending Section 301(b)1
to read as follows:
"1. Fences not over 6 feet high and open wire fences
without slats up to 8 feet in height plus up to three
strands of barbed wire on top "
SECTIOPI 6 .
That Section 7-47 of the Code of the City of Fort Worth
(1986) , as amended, is hereby amended. by adding a Section 514 to
Chapter 5, Classification of All Buildings By Use or Occupancy
and General Requirements For All Occupancies, to read as follows:

"Chain Link Fences.
Sec. 514. Chain link fences 6 feet and lower shall have
~' the top finish twists (selvages) turned under or
knuckled."
SECTION 7.
That Section 7-47 of the Code of the City of Fort Worth
(1986), as amended, is hereby amended by amending Section 4607(d)
to read as follows:
"{d) Application schedule for permanent encroachments.

SECTION 8.
That Section 7-47 of the Code of the City of Fort Worth
(1986), as amended, is hereby amended by changing Exception 3 to
Section 3801(d) to read as follo~os:
"3 Where sprinklers are installed in electrical rooms
they shall be separated from the building's main
sprinkler system by a pre-action valve. This
valve shall be connected to fire detection
device(s) in the electrical room. Sprinkler
piping shall remain dry until the fire detection
device activates and opens the pre-action valve.
Sprinkler head(s) shall be of a type to remain
closed until sufficient heat is present to open
them. Detection devices shall have a minimum
temperature rating of 165 degrees Fahrenheit. The
sprinkler(s) shall have a minimum temperature

rating of 212 degrees Fahrenheit. Sprinkler heads
in electrical rooms shall be protected with a
listed guard over the head. Sprinkler heads may
be installed in electrical rooms without the
,ri pre-action valve, fire detection device and guard
if approved tamper proof sprinkler heads are
installed in place of the standard heads."
SECTION 9.
This ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth, Texas
(1986), as amended, except where the provisions of this ordinance
are in direct conflict with the provisions of such ordinances and
such Code, in which event conflicting provisions of such ordi-
nances and such Code are hereby repealed.
SECTION 10.
It shall be unlawful for any person to erect, construct,
enlarge, alter, repair, move, improve, remove, convert, demolish,
equip, use, occupy, or maintain any building or structure in the
City or cause the same to be done contrary to or in violation of
any of the provisions of this Code. Any person, firm, or
corporation who violates, disobeys, omits, neglects, or refuses
to comply with or who resists enforcement of any of the
provisions of this Code with respect to fire safety shall be
fined not more than Two Thousand Dollars ($2,000.00) for each
offense, and with respect to all other provisions of this Code
shall be fined not more than Two Hundred Dollars ($200.00) for
each offense. Each day that a violation is permitted to exist
shall constitute a separate offense

SECTION 11.
It is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and, if any phrase,
clause, sentence, paragraph or section of this ordinance shall be
declared unconstitutional by the valid judgment or decree of any
court of competent jurisdiction, such unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences, para-
graphs and sections of this ordinance, since the same would have
been enacted by the City Council without the incorporation in
this ordinance of any such unconstitutional phrase, clause, sen-
tence, paragraph or section
SECTION 12.
All rights and remedies of the City of Fort Worth, Texas,
are expressly saved as to any and all violations of Ordinance
No. 10115, as amended, or any other ordinances affecting
construction and fire safety, which have accrued at the time of
the effective date of this ordinance; and, as to such accrued
violations and all pending litigation, both civil and criminal,
whether pending in court or not, under such ordinances, same
shall not be affected by this ordinance but may be prosecuted
until final disposition by the courts.
Building permits heretofore issued under existing ordinances
shall be valid for the time being for which they are issued under
the existing Building Code, but, upon expiration thereof, the
same shall be void.

SECTION 13.
This ordinance constitutes a digest and revision of the
Building Code of the City of Fort Worth, as provided in
Section 2, Chapter XXV, and Section 9, Chapter XXVII, of the
Charter of the City of Fort Worth. The City Secretary of the
City of Fort Worth, Texas, is hereby authorized to publish this
ordinance in pamphlet form for general distribution among the
public, and the operative provisions of this ordinance, as so
published, shall be admissible in evidence in all courts without
further proof than the production thereof, as provided in
Chapter XXV, Section 3, of the Charter of the City of Fort Worth,
Texas
SECTION 14.
The City Secretary of the City of Fort Worth is hereby
directed to engross and enroll this ordinance by copying the cap-
tion, penalty clause and effective date in the minutes of the
City Council and by filing the ordinance in the ordinance records
of the City
SECTION 15.
The City Secretary of the City of Fort Worth, Texas, is here-
by directed to publish the caption, penalty clause and effective
date of this ordinance for two (2) days in the official newspaper
of the City of Fort Worth, Texas, as authorized by Section
52.013, Texas Local Government Code.

SECTION 16.
This ordinance shall be in full force and effect thirty (30)
days after its passage and publication, and it is so ordained.

(described below) which amends the City of Fort Worth Building Code as
~~~~ recommended by the Construction and Fire Prevention Board of Appeals.

The proposed changes will result in a benefit for the citizens by making the
city a safer place to live and work.
1) Section 1. This proposed ordinance amendment wil] correct an oversight
that took place when the 1988 Uniform Building Code was adopted.
' Currently, the existing building provisions require basement access or
sprinkler protection for existing buildings other than high-rise
buildings, but due to an oversite, this provision was left out of the
high-rise existing building requirements. By adding this amendment, the
more complicated and potential Ty hazardous high-rise existing building
will be treated the same as other buildings;
2) Section 2. This proposed ordinance amendment will provide the
requirement to keep buildings and structures in repair and require
painting or preserving of the building or structure surfaces. It
specifically exempts wooden screening fences from the requirement of
painting or preservation treatment,
3) Section 3. This proposed ordinance amendment corrects an oversite that
was unintentionally left out of the current ordinance. It allows a
parapet wall to terminate at the underside of a non-combustible roof
rather than to a minimum 30-inch height above the roof surface. The
current requirement is too restrictive and unnecessary,
4) Section 4. This proposed ordinance amendment adds special security
requirements for two-family residences and apartments. These additional
security items were recommended by the Fort Worth Commission on the
Status of,Women to assist in making rental-type dwellings where single
females may be residing a more secure home for them,
5) Section 5. This proposed ordinance amendment relaxes the requirement
for permits where fences up to six feet (6') high and open wire fences
without slats up to eight feet (8') high and allows up to three strands
of barbed wire on top. Previously, permits were required for all fences
over six feet (6') high,
6) Section 6. This proposed ordinance change requires the twisted ends on
the top of a chain-link fence six feet (6') and less in height to be
bent or turned under to lessen the possibility of injury. This is a
fence industry suggestion;

7) Section 7. This proposed ordinance change increases the fees for
permanent encroachment onto public property as suggested in the citywide
fee survey. The fees are increased from $50.00 to $100.00 in item 1,
$100.00 to $200.00 in item 2, and, $200.00 to $300.00 in item 3.,
8) Section 8. This proposed change allows for a second alternative to
providing safe sprinklering of electrical rooms which in many cases may
be less expensive. It allows a tamperproof sprinkler head to be used
instead of a dry system controlled by a preaction valve with a safety
guard.
