ORDINANCE N0. ~ ~~
AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND
EXTINGUISHING A PORTION OF THE SOUTH RIGHT-OF-WAY OF
WEST MAGNOLIA AVENUE AND A PORTION OF THE EAST
RIGHT-OF-WAY OF FIFTH AVENUE, AS MORE PARTICULARLY
DESCRIBED HEREIN; PROVIDING FOR REVERSION OF FEE IN
SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HERE-
WITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That a portion of the south right-of-way of West Magnolia
Avenue, of variable width from six inches to 1.7 feet along the
north line of Lot 16-R, Block "A", King's Subdivision of Block 27
of Fields-Welch Addition, and a portion of the east right-of-way
of Fifth Avenue, a width of 10.2 feet for a distance of 75.21
feet along the west line of said Lot 16-R, as recorded in
Volume 388-211, Page 96, Plat Records, Tarrant County, Texas,
said portions of right-of-way being more particularly described
in Exhibit "A", attached hereto and incorporated herein, be and
the same are vacated, abandoned, and permanently closed and
extinguished as public street rights-of-way.
SECTION 2
That the fee to the land in the above described: vacated pub-
lic street rights-of-way is hereby released and shall revert to
the adjacent owner as provided by law
SECTION 3.
That all ordinances or parts of ordinances in conflict here-
with are hereby repealed.

SECTION 4.
That this ordinance shall take effect and be in full force
and effect from and after the date of its passage, and it is so
ordained.

RECOMMENDATION
It is recommended that the City Council adopt an ordinance
vacating a portion of the south right-of-way of West Magnolia
Avenue a variable width from 6 inches to 1 7 feet along the north
line of Lot 16-R and to vacate a portion of the east right-of-way
of Fifth Avenue a width of 10.2 feet for a distance of 75.21 feet
along the west line of Lot 16-R, Block "A", Kings Subdivision of
Block 27 of Fields-Welch Addition as recorded in Volume 388-211,
Page 96, P.R T C T
DISCUSSION
The Summit Group, on behalf of Amwest Savings Association, owner
of all abutting property, has requested that the City vacate the
above-described street right-of-way as shown on the attached map
.~
The subject street, acquired by dedication, is partially occupied
by an existing building in the Fifth Avenue portion of the
subject request There are no utility facilities located within
the right-of-way requested for a vacation The subject vacation
request has been proposed in order to replat the vacated
right-of-way with the adjoining lot to eliminate the current
structural encroachment question.
Reviewing City departments and private utility companies have
raised no objections to this request The Development Review
Committee, during its meeting on July 19, 1990, recommended
approval
The subject request was included on the Plan Commission agenda
for consideration and recommendation during their regular meeting
on July 25, 1990 However, the required quorum of six (6)
members was not present for the hearing and all items contained
on the agenda were carried over and scheduled to be heard on
August 29, 1990 The applicant has informed City Staff that the
Small Business Association (S B A ) has established an early date
for closure on the subject property, which will occur a
considerable time prior to the August Plan Commission meeting
