HomeMy WebLinkAboutOrdinance 10559ORDINANCE NO / ~~®" AN ORDINANCE VACATING, ABANDONING, AND CLOSING A POR- TION OF WEST DAGGETT AVENUE LOCATED BETWEEN HE:MPHILL STREET AND JENNINGS AVENUE, A STRIP OF LAND RESERVED FOR RIGHT-OF-WAY ADJACENT THERETO, AND TWO PUBLIC OPEN SPACE EASEMENTS LOCATED IN BLOCK 18, JENNINGS SOUTH ADDITION; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH:; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following be and the same are vacated, abandoned and permanently closed and extinguished: A That portion of West Daggett Avenue located between Hemphill Street and South Jennings Avenue; B. A ten (10) foot wide strip of land adjacent to the north line of the above portion of West Daggett Avenue which was reserved for future street right-of-way; and C. Two (2) public open space easements located in the southwest and southeast corners of Block 18, Jennings south Addition; all as described in Exhibit "A" attached hereto and incorpo- rated herein SECTION 2. That the fee to the above-described vacated public street right-of-way and public open space easements is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities and any and all existing and prospec- tive drainage requirements as necessary. SECTION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. DATE ~~ ~ ' REFERENCE suB~ECr VACATION OF A STREET RIGHT- PAGE eti,•~•s NUMBER OF-WAY, A "FUTURE STREET WIDENING 1 4-03-90 '~*P Z-1575 RESERVATION" AND TWO PUBLIC OPEN )~~ SPACE EASEMENTS JENNINGS SOUTH ces.s ADDITION, BLOCK 18, WEST DAGGETT AVENUE BETWEEN HEMPHILL STREET "'"'$~"~tl('~~ AND SOUTH JENNINGS AVENUE (U-89-23) 1'!1 Rt1[tQM•A x RECOMMENDATION It is recommended that the City Council adopt an ordinance vacating a 41.6' wide x 448.98' long portion of West Daggett Avenue, located between Blocks 18 and 19, Jennings South Addition, as recorded in Volume 388-178, Page 11, P.R.T.C.T., a 10' wide (same length as street) "Future Street Widening Reservation" located adjacent to the north line of the said West Daggett Street right-of-way and within the said Block 18, and two (2) 20' x 20' public open space easements (P.O.S.E.'s) located in the southeast and south- west corners of the same said Block 18, as recommended by the City Plan commission. DISCUSSION James L. Brittain, surveyor, representing Justin Boot Company, owner of all adjacent property, has requested that the City vacate the above described street right-of-way, "Future Street Widening Reservation," and public open space easements (P.O.S.E.'s) as shown on the attached map and further described in the attached field notes, Appendix A. The subject street is open on the ground and does contain electric, gas, tele- phone, and water utility facilities. Arrangements have been made to retain existing utility facilities within a dedicated drainage and utility easement (dedicated by plat). The subject vacation request is being made in order to include the vacated street right-of-way, "Future Street Widening Reservation," and public open space easements (P.O.S.E.'s) as part of the Justin Boot Company facility. The Land Agent for the City of Fort Worth has determined that a $32,368.00 consideration will satisfy the interest of the City in this public right-of-way. Reviewing City departments and private utility companies have raised no objec- tion to this request. A satisfactory replat has been submitted.
