HomeMy WebLinkAboutOrdinance 10662r ,~ ;, •-• _ ORDINANCE NO ~l/ ll/ ~/o~ AN ORDINANCE APPROPRIATING $300,000 00 TO THE GENERAL FUND, FUND GGO1, NON-DEPARTMENTAL ACCOUNT, CENTER NO. 0909101, AND DECREASING THE UNRESTRICTED, UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT FOR THE PURPOSE OF ADDITIONAL ENGINEERING SERVICES FOR OVERSIGHT AND IMPLEMENTATION OF THE CITY'S UNDERGROUND STORAGE TANK REMEDIATION PROGRAM BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS• SECTION 1. That in addition to those amounts allocated to the various City departments for the Fiscal Year 1989-90 and in the Budget of the City Manager, there shall also be increased appropriations in the General Fund, Fund GGO1, Center No. 0909101, in the amount of $300,000.00, thereby decreasing the unrestricted, undesignated Fund Balance by the same amount, for the purpose of additional engineering services for oversight and implementation of the City's underground storage tank remediation program. SECTION 2 Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 10363 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and effective date into the minutes of the City Council and by filing this ordinance in the ordinance records of the City of Fort Worth ,n. ,,~ . ~. Approve the transfer of 5300,000 from General Fund GGO1, Non-Departmental-Special Transfers Center No. 0909101 to Specially Funded Capital Projects Fund GC35, Center No. 021021100000, Underground Storage Tanks, and 3 Authorize the City Manager to execute an amendment to City Secretary Contract No 17498 with Environmental Managers,, Inc., a Fort Worth firm for additional engineering servi:c,es for oversight and implementation of the City's underground storage tank remediation program, increasing the projected cost by $300,000 -from $171,000 to $471,000 BACKGROUND On September 19, 1989 (M&C 11879), the City Council authorized the City Manager to execute an engineering contract with Environmental Managers, Inc, for the development of the City's underground storage tank program for a cost not to exceed $346,000; $175,000 (Phase I) was for the development of a compliance plan, preparation of general specifications and contract documents, tank inventories and soil resistivity; 5171, 000.; "~ ~(,Pha"see, II) was for engineering oversight on tank remedi at i•on r~pro`j ects . DISCUSSION ~:.,~ :,.. s, During the original contract negotiations the exact costs associated with~Phase II could not be determined, therefore, the projected tcost;t.was based on the known 120 underground storage tanks (UST,`~S),.~ _owned by the City. On July 16, 1990 Environmental Managers ',s Inc., informed staff that due to the increase in UST sites al.onglwith unscheduled remediation of UST's not anticipated under the original contract, the money appropriated under Phase II would not cover the anticipated work remaining under this Phase. Work is continuing with on-site assessments, and remediation of five (S) sites. In addition, the proposed compliance plan outlinesabandonment and/or :removal of tanks from 34 sites. The extent of engineering work required on the above sites cannot be~determined. However, based on the extent and severity of the sites already encountered and EMI's projected cost, staff anticipates that an additional 5300,000 may be necessary to accomplish required site assessment, remediation and reports on projects currently underway or anticipated to'begin.~ The underground storage tank remediation fund as administered by the Texas Water Commission (TWC) will cover certain costs associated with underground storage tank remediation programs. Staff anticipates the majority of the cost associated with this contract will be covered by this fund. FINANCING Upon approval and completion of Recommendations #1 and #2, sufficient funds will be available in the Specially Funded Capital Projects Fund GC35, Center No. 021021100000, Underground Storage Tanks. Expenditures will be made from Account No. 531200 The unreserved, undesignated General- Fund balance after this transfer will be 525,730,519.
