ORDINANCE NO. CP
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING THAT PORTION OF DEEN ROAD LOCATED BETWEEN
TERMINAL ROAD AND DOWNING DRIVE; PROVIDING FOR REVER-
SION OF FEE IN SAID LAND; PROVIDING FOR RETENTION OF
UTILITY EASEMENT; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
THAT the following be and the same is vacated, abandoned and
permanently closed and extinguished as a public street right-of-
way:
That portion of Deen Road extending from the north
right-of-way line of Terminal Road north to the south
right-of-way line of Downing Drive.
SECTION 2.
That the fee to the land in the above described vacated pub-
lic street right-of-way is hereby released and shall revert to
the adjacent owner as provided by law, SAVE AND EXCEPT that ease-
ments are retained for any and all existing utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict here-
with are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force
and effect from and after the date of the formal opening to
general traffic of the Meacham Boulevard Overpass (Project No.
30-02391-00) and until such time the above-referenced portion of
Deen Road shall remain open as a public street right-of-way. The
Director of Transportation/Public Works is directed to advise the
City Secretary of the date of the opening of such Overpass, who
shall inscribe such date hereon as the effective date of this
ordinance, and it is so ordained.

RECOMMENDATION
It is recommended that the City Council adopt an ordinance vacating Deen
Road from the North Right-of-Way line of Terminal Road'No~th- to the South
Right-of-Way line of Downing Drive, located in Block 4, Burlington
Industrial District; Block 1, Fort Worth and Denver Railroad Addition;
adjacent to the Burlington Northern Railroad Yards located in the W. Baker
Survey, Abstract 145, provided that the effective date for said ordinance is
the date of the opening to traffic of the railroad overpass an Meacham
Boulevard.
DISCUSSION:
Gary Santerre, Director of the Department of Transportation and Public
Works, with the consent of Burlington Northern Railroad Company, has
requested that the City vacate Deen Road as described above and shown on the
attached map.
The subject street, acquired by prescription, is open on the ground and
contains water, gas, telephone and electric utility facilities. By
agreement of the City Plan Commission on August 29, 1990, vacation of the
subject street right-of-way has been recommended for approval subject to the
vacated right-of-way being retained as a utility easement for existing
utility facilities only and that this portion of Deen Road remain open to
traffic until the proposed Meacham Boulevard from Inter-state Highway #35W
to Blue Mound Road, including the proposed railroad overpass, is completed.
The proposed vacation has been made in order to accommodate the expansion of
Meacham Boulevard.
Reviewing city departments and private utility companies have raised no
objection to this request. The City Plan. Commission, during action taken at
the August 29, 1990 Plan Commission Meeting, approved this vacation,
deleting the requirement for plat. APPROVED BY
