HomeMy WebLinkAboutOrdinance 10669K ~ ~ R t z ~ ~ - ORDINANCE N0. _~D q AN ORDINANCE APPROPRIATING $325,000.00 TO THE UNEMPLOYMENT COMPENSATION INSURANCE FUND, FUND FE86, RISK MANAGEMENT DEPARTMENT CENTER NUMBER 01'58610 AND DECREASING THE UNRESTRICTED, UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT FOR THE PURPOSE OF PAYING WORKERS' COMPENSATION CLAIMS AND EXPENSES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those .amounts allocated to the various City departments for the Fiscal Year 1989-90 and in the Budget of the City Manager, there shall also be increased appropriations in the Unemployment Compensation Insurance Fund, Fund FE86, Risk Management Department, Center Number 0158610, in the amount of $325,000.00; thereby decreasing the unrestricted, undesignated Fund Balance by the same amount, for the purpose of paying workers' compensation claims and expenses SECTION 2. Y Should any portion, section or part of a section of , this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect, SECTION 3. That this ordinance shall be cumulative of Ordinance No. 10363 and a]1 other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and effective date into the minutes of the City Council and by filing this ordinance in the ordinance records of the City of Fort Worth. ~. r`M ~, " 1 i4 ~. ,•- SECTION 5. DISCUSSION: The Fiscal Year 1989-90 Budget included $5,812,200 for workers' compensation claims and expenses. The City historically budgets only for those claims expected to be paid during the budget year under consideration. An individual claim for Workers' Compensation may take from two to eight years before claim settlement or completion is reached. However, this year the City has cleared some major claims earlier than antici- pated; and, due to the severity of the claims and expenses, as compared to the same time frame last fiscal year, additional money is needed for the remainder of this fiscal year. Annually, the City's Operating Funds contribute to the City's Insurance Funds for each fiscal year. If total expenses for any given fiscal year are less than the total revenues collected, the remaining balance reverts to the unre- served, undesignated fund balance. The Workers' Compensation Insurance Fund FE73 does not have any retained earnings available to cover the increased expenses incurred during Fiscal Year 1989-90. Staff recommends the use of retained earnings from Unemployment Compensation Insurance Fund FE86 because the fund balance of the Fund FE86 represents excess monies received proportionately from the various operating funds. These funds have accumulated due to the City's successful program of outplace- ment and successful defense against unwarranted unemployment compensation claims. ~' ..~ : w.,. -_-~ DATE NUMBER CE SUBJECT SU$PLEMENTAL APPROPRIATION PAGE 9-18-90 **G-8799 ORDINANCE FOR WORKERS' COMPENSATION 2 of 2 FINANCING: Upon approval and completion of Recommendation No. 1, sufficient funds will be available for transfer from Unemployment Compensation Fund FE86, Transfers Out Account 53807 0, Center No. 0158610. The unreserved, undesignated fund balance in Unemployment Compensation Insurance Fund FE86 will be $964,137 after this transaction. Upon approval and completion of Recommendation No. 2, sufficient funds will be available in Workers' Compensation Fund FE73, Center No. 0157300 for expendi- tures for the remainder of the fiscal year.
