O AN ORDINANCE AMENDING SECTION 35-56(b), SECTION 35-56(g) AND SECTION 35-56(h) OF CHAPTER 35 OF THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED, REVISING CERTAIN RATES AND CHARGES; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1. That Section 35-56(b) of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, be and the same is hereby amended and, after having been amended, shall be read as follows: "(b) The following schedule of rates per month, or fraction thereof, shall be the charges to all residential and nonresidential customers for furnishing water to such customer located within the city. The residential monthly volume charge for water service shall be the charges to the residential customer class, as defined in this chapter, for' furnishing water to residential water customers located within the city The nonresidential monthly volume charge for water service shall be the charges to the nonresidential customer class, as defined in this chapter, for furnishing water to nonresidential water customers located within the city." SECTION 2. That Section 35-56 (g) of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, be and the same is hereby amended and, after having been amended, shall be and read as follows: "(g) The following schedule of rates per month, or fraction thereof, shall be the charges to all wholesale customers for furnishing water to such customers. Rate for Wholesale Water Service Volume ($/1,000 gallons)* $0.4272 Maximum Day ($/Mgd excess) $79,212 Maximum Hour ($Mgd excess} $28,080 Customer ($/Meter/month) $ 25 *plus raw water cost SECTION 3. That Section 35-56 (h) of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, be and the same is hereby amended and, after having been amended, shall be and read as follows: 3 S "(g) The following schedulefof rates per month, or fraction thereof, shall be the charges to all wholesale customers for furnishing wastewater service to such customers. Rate for Wholesale Wastewater Service Volume ($/1,000 gallons) $0.3597 B.O.D. ($/pound) $0.1225 Suspended Solids ($/pound) $0.1024 Customer ($/month) $ 71 SECTION 4. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 5 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. 4 - ~. SECTIONP6.• The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECTION 7 That this ordinance shall become effective and be in full force and effect from and after its passage; provided, however, that the increased rates specified herein shall apply to residential, nonresidential, and wholesale utility statements sent by the City of Fort Worth on or after November 1, 1990, and it is so ordained. DISCUSSION: For FY 1991 rates, a water rate study and a wastewater rate study were completed by Peat Marwick Mairr and Company. The studies indicated. in the following rate structures will recover the costs of providing wholesale service. A joint meeting of the Wholesale Water Advisory Committee and the Wholesale Wastewater Advisory Committee was held July 19, 1990 to present the. studies and the rate requirements. A second, meeting of the Wastewater Advisory Committee occurred August 1. It presented wastewater rates based on alternate computation methodologies. Fort Worth revenue requirements and concerns of the wholesale customers as expressed in these meetings are addressed in the proposed rates.
