RECOMMENDATION.
It is recommended that the City Council adopt an ordinance vacating an 80'
long portion of a 12' wide alley located between Lots 15 and 16 and Lot 1-R,
Block 13, Brooklyn Heights Addition, as recorded in Vol. 63, Page 13, and a
15' X 15' public open space easement (P.O.S.E.) located at the northeast
corner of Lot 1-R at the intersection of the alley and Montgomery Street,
Block 13, Brooklyn Heights Addition, as recorded in Cabinet A, Slide 100,
P.R.T.C.T., as recommended by the City Plan Commission.
DISCUSSION
Gordon S. Swift, engineer and surveyor, representing the owner of all
adjacent property, has requested that the City vacate the above described
alley right-of-way and public open space easement (P.O.S.E.) as shown on the
attached map and further described in the attached field notes in Appendix A.
The subject alley is open on the ground and does contain electric, gas,
telephone, and sewer utility facilities. Arrangements have been made to
retain the existing utility facilities within a dedicated utility easement
(dedicated by separate instrument). The subject vacation request is being
made in order to include the vacated alley right-of-way and public open space
easement (P .O.S.E.) as part of the subject property.
The Land Agent for the City of Fort Worth has determined that a $1,632.60
consideration will satisfy the interest ofi the City in this public
right-of-way.
Reviewing City departments and private utility companies have raised no
objection to this request. A satisfactory replat has been submitted.
