AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING (I) A PORTION OF AN ALLEY RIGHT-OF-WAY AND (II) A PUBLIC OPEN SPACE EASEMENT LOCATED WITHIN THE BROOKLYN HEIGHTS ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID ALLEY RIGHT-OF-WAY; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following alley right-of-way and public open space easement, each more particularly described in Exhibit "A" (attached hereto and incorporated herein by reference) be and they are vacated, abandoned, permanently closed, and extin- guished: (1) An eighty (80) foot portion of the twelve (12) foot wide alley right-of-way located between Lots 15 and 16, and Lot 1-R, Block 13, of the Brooklyn Heights Addition to the City of Fort Worth, Texas, as recorded in Volume 63, Page 13, of the Plat Records of Tarrant County, Texas; and (2) A public open space easement located in the northeast corner of Lot 1-R, Block 13, of the Brooklyn Heights Addition to the City of Fort Worth, Texas, as recorded in Cabinet A, Slide 100, of the Plat Records of Tarrant County, Texas. SECTION 2. That the fee to the land in the vacated alley right-of-way and public open space easement is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospec- tive utilities. i~ t ,~' ~ ~ 1 n f'.. It is recommended that the City Council adopt an ordinance vacating an 80' long portion of a 12' wide alley located between Lots 15 and 16 and Lot 1-R, Block 13, Brooklyn Heights Addition, as recorded in Vol. 63, Page 13, and a 15' X 15' public open space easement (P.O.S.E.) located at the northeast corner of Lot 1-R at the intersection of the alley and Montgomery Street, Block 13, Brooklyn Heights Addition, as recorded in Cabinet A, Slide 100, P.R.T.C.T., as recommended by the City Plan Commission. DISCUSSION Gordon S. Swift, engineer and surveyor, representing the owner of all adjacent property, has requested that the City vacate the above described alley right-of-way and public open space easement (P.O.S.E.) as shown on the attached map and further described in the attached field notes in Appendix A. The subject alley is open on the ground and does contain electric, gas, telephone, and sewer utility facilities. Arrangements have been made to retain the existing utility facilities within a dedicated utility easement (dedicated by separate instrument). The subject vacation request is being made in order to include the vacated alley right-of-way and public open space easement (P .O.S.E.) as part of the subject property. The Land Agent for the City of Fort Worth has determined that a $1,632.60 consideration will satisfy the interest ofi the City in this public right-of-way. Reviewing City departments and private utility companies have raised no objection to this request. A satisfactory replat has been submitted.
