HomeMy WebLinkAboutOrdinance 10578lr .~ +' `~ ~~,;.,,. ~ y:r ~ ~ ORDINANCE N0. ~c~S 7 AN ORDINANCE CALLING FOR AND ORDERING AN ELECTION FOR JULY 10, 1990, ON THE QUESTION OF THE ISSUANCE OF BONDS WHEREAS, the City Council of the City of Fort Worth deems it advisable to issue the bonds of said City for the purposes herein- after stated: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That an election shall be held in said City on Tuesday, the 10th day of July, 1990, between the hours of 7:00 A.M and 7:00 P M , in the several regular election precincts of said City which are the regular precincts of Tarrant County and Denton County, Texas, to the extent they are within the city limits of said City, and the polling places as set forth on Exhibit "A" attached hereto and made a part hereof That in calling for and ordering said election, the City Council expressly finds, pur- suant to Section 41.001(b)(3) of the Texas Election Code, that the holding of said election on July 10, 1990, rather than on a uniform election date, is in the public interest, which finding shall be conclusive and incontestable SECTION 2 That at said election, the following propositions shall be submitted in accordance with law: ,Y< w ,i ~ ~ w #+ ~ . r e .. ~ ,_ - ., ~. y. :~ PROPOSITION NO..l Shall the City Council of said city be authorized to issue the bonds of said city, in one or more series or issues, in the aggregate principal amount of $20,000,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed forty years from their date, and to be sold at such prices and bear interest at such rates as shall be determined by the City Council, for the purpose of constructing permanent improvements at the City's Will Rogers Memorial Complex, to wit: the Will Rogers Auditorium; and other related permanent improvements thereto; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PROPOSITION N0. 2 Shall the City Council of said city be authorized to issue the bonds of said city, in one or more series or issues, in the aggregate principal amount of $20,000,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed forty years from their date, and to be sold at such prices and bear interest at such rates as shall be determined by the City Council, for the purpose of con- structing permanent street and storm sewer improvements by reconstructing, restructuring and extending the streets, thoroughfares, collectors and storm drains in said city, and related street and storm sewer improve- ments; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? SECTION 3 That the official ballots to be used in said election shall be prepared in accordance with Sections 52 072 and 52 073 of the Texas Election Code, as amended. Said ballots shall permit the electors to vote "For" or "Against" the aforesaid propositions, which shall be set forth in substantially the following form: 2 ~ r - .~~ f z .. .. ~~ OFFICIAL BALLOT (Completely blacken in the box beside the statement indicating the way you wish to vote.) PROPOSITION N0. 1 ^ For WILL ROGERS MEMORIAL COMPLEX IMPROVEMENT BONDS IN THE AGGREGATE SUM OF $20,000,000 ^ Against PROPOSITION N0. 2 ^ For STREET AND STORM SEWER IMPROVEMENT BONDS IN THE AGGREGATE SUM OF $20,000,000 ^ Against SECTION 4 That the City Secretary is hereby ordered and directed to prepare and issue ballots for voting in said election and to stamp same "Official Ballot." Said ballots shall be printed in English and in Spanish for use in said election. SECTION 5. That all resident, qualified electors of the City shall be entitled to vote at said election. SECTION 6. That the propositions, as hereinabove set forth, if approved by a majority of the qualified voters voting upon said propositions, shall be deemed to have been approved by the electorate as soon as an official order has been entered on the Council Minutes of said City by the City Council, declaring the same approved. 3 .~ r .~ .~ SECTION 7. That the City Secretary of the City of Fort Worth shall furnish election officials said ballots and voting equipment, together with any other forms, blanks or instructions in accor- dance with the Charter of the City of Fort Worth, Texas, and the laws of the State of Texas, insofar as same are applicable, and with the provisions of this ordinance. SECTION 8 That the polls shall be kept open from 7:00 o'clock A.M until 7:00 o'clock P.M July 10, 1990, and that due return shall be made to the City Council showing the number of votes cast for and against the propositions. SECTION 9. That the location of the polling places for the election, except insofar as they may be changed by the City Council, are set forth on Exhibit "A" attached hereto and made a part hereof SECTION 10 That the City Council shall appoint a Presiding Judge and an Alternate Presiding Judge for each precinct or portion thereof within the City. Each Presiding Judge shall appoint not less than two nor more than three qualified election clerks to serve and assist in conducting said election, provided that, if the Presiding Judge actually serves as expected, the Alternate Presiding Judge shall be one of such clerks 4 SECTION 11. A. An electronic voting system, as defined in Chapter 121 of the Texas Election Code, as amended, shall be used for voting at the regular polling places at said election and for counting the ballots and the tabulation of the results. The conduct of the election and the use of the electronic voting system shall be in accordance with the Texas Election Code, as amended B. The Office of the Tarrant County Elections Administrator, Tarrant County Courthouse, 100 Weatherford, Fort Worth, Texas 76196, is hereby established as the Central Counting Station for the ballots cast in said election. C. Robert Parten, having knowledge and experience in the conduct of elections with the electronic voting system for which the Central Counting Station is established, and being a regis- tered voter of the City of Fort Worth, is hereby appointed as the Manager of the Central Counting Station. The Manager shall be in charge of overall administration of the Central Counting Station and the general supervision of the personnel working at said Station D. Wendy Sharp, being trained in the operation of the auto- matic tabulating equipment installed at the Central Counting Station, is hereby appointed Tabulation Supervisor. The Tabulation Supervisor shall be in charge of the operation of the automatic tabulating equipment. E. The appointments of Lynda Schaefer, Donna Calton and Connie Beckham as Assistants to the Tabulation Supervisor are hereby approved. They shall assist the Tabulation Supervisor in 5 ~, the operation of the automatic tabulating equipment as directed by the Tabulation Supervisor. F. Patricia Benavides is hereby appointed as Presiding Judge of the Central Counting Station She shall maintain order at the Central Counting Station and shall have such authority as may be prescribed by the Texas Election Code, as amended. SECTION 12. That Ruth Howard, City Secretary of the City of Fort Worth, shall conduct and shall be the clerk for absentee voting at said election. That Robert Parten, Tarrant County Elections Administrator, will serve as chief deputy absentee voting clerk Absentee voting shall be conducted by two methods: A Voting by personal appearance; and B. Voting by mail at the office of the Tarrant County Elections Administrator, County Annex West, 600 West Weatherford, Fort Worth, Texas 76102. Absentee voting shall be on paper ballots, and such ballots shall conform to the requirements of the Texas Election Code, as amended, which provides that a box shall be placed beside the proposition, in which the voter is requested to blacken in the box to indicate the way he or she wishes to vote, but which also provides that failure of a voter to mark his or her ballot in strict conformity with the instructions on the ballot shall not invalidate the ballot, and the ballot shall be counted if the intention of the voter is clearly ascertainable, except where the law expressly prohibits the counting of the ballot. It is spe- cifically provided that the election officers shall not refuse to count a ballot because of a voter having marked his or her ballot 6 e ,' ~ n 1 j by scratching out the proposition for which he or she does not wish to vote; and in this connection the attention of the Absentee Ballot Board is directed to the provisions of Section 65.009 of the Texas Election Code, as amended. Absentee voting by personal appearance shall be conducted on weekdays only, beginning June 20, 1990, and continuing through July 6, 1990. Such weekday absentee voting shall be conducted at the following locations at the following times: Location Office of the City Secretary 3rd Floor, Fort Worth Municipal Bldg. 1000 Throckmorton Street Fort Worth, Texas 76102 County Annex West 600 West Weatherford Fort Worth, Texas 76102 Griffin Sub-Courthouse 3206 Miller Avenue Fort Worth, Texas 76119 Southwest Sub-Courthouse 3829 Altamesa Boulevard Fort Worth, Texas 76133 Time 8:00 a.m. to 5:00 p.m. 8:00 a.m. to 4:30 p.m 8:00 a.m. to 4:30 p.m. 8:00 a.m. to 4:30 p.m. In addition, absentee voting by personal appearance also shall be conducted on Saturday, June 30, 1990, at each of the above locations during the same hours which are specified for weekday absentee voting for that particular location. SECTION 13. That the Absentee Ballot Board is hereby created to process absentee voting results, and Barney Koons is hereby appointed as Presiding Judge. The Presiding Judge shall appoint at least two other members to such Board 7 3 ~ y .1 SECTION 14. That said election shall be held under the provisions of the Charter of the City of Fort Worth, Texas, and the Constitution and laws of the State of Texas, insofar as same may be appli- cable, and all persons qualified to vote in said City under the laws of this state regulating general elections shall be allowed to vote. SECTION 15. This ordinance shall constitute the proclamation, call, notice and ordinance calling and ordering said election. SECTION 16. That notice of said election shall be given by posting a substantial copy of this ordinance in English and in Spanish in three (3) public places of said City and also at the City Hall, not less than 15 days prior to the date set for said election; and a substantial copy of this ordinance also shall be published in English and in Spanish on the same day in each of two succes- sive weeks both in the Fort Worth Commercial Recorder and the Fort Worth Star-Telegram, which are newspapers of general circula- tion published in said City, the date of the first publication to be not earlier than the 30th day and not less than 14 days prior to the date set for said election. SECTION 17. That the way and manner of holding said election, the notice to be given therefor, the polling places, the personnel and the officers, precinct judges and substitutes therefor, who are to hold same, and all details connected with the holding of the elec- 8 r s tion shall be provided for and arranged by the City Secretary; that the proper notice and publication of this notice, proclama- tion and ordinance shall only be cumulative of and in addition to the statutory notice of said election as herein provided; and that any omission or irregularity in the publication of this notice, proclamation and ordinance, or in the signing of same, shall not in any way affect or invalidate such election. SECTION 18. That in all respects, said election shall be conducted in accordance with the Texas Election Code, as amended. SECTION 19. That it is hereby officially found and determined that the meeting at which this ordinance was adopted and said election was called was open to the public and public notice of the time, place and purpose of said meeting was given, all as required by Vernon's Annotated Civil Statutes, Article 6252-17, as amended. SECTION 20. That this ordinance, election order, proclamation and. notice shall take effect and be in full force and effect from and after the date of its passage, and it is so oined.
