HomeMy WebLinkAboutOrdinance 10590~~~ ; i ORDINANCE N0. /~ 9~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING A STRIP OUT OF THE 6000 BLOCK OF RANDOL MILL ROAD; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PRO- VIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 THAT the one thousand one hundred sixty-five (1,165) foot long variable width strip of Randol Mill Road located within the James F Redding Survey and the G. W. Main Survey in the City of Fort Worth, said strip being more particularly described in Exhibit "A" which is attached hereto and incorporated herein by reference for all purposes, be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated street right-of-way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3 That all ordinances or parts of ordinances in conflict here- with are hereby repealed. 'pc : , x SECTION 4. Redding Survey, Abstract No. 1302 and the G. W. Main Survey, Abstract No. 1097, all in Tarrant County, Texas, and said Tract being tied to the Texas State Coordinate System, North Central Zone; using a combined grid and elevation factor of 0.9998699 and said tract being more particularly described as follows: BEGINNING at a point in the southeast line of said DAON property, said point being S 33° 02' 25" W, 38.81 feet from the east corner of said property in the center of the original Randol Mill Road, said point being perpendicular to and 60 feet southerly from Centerline Station 102+99.96 on new Randol Mill Road, said point being in the G.W. Main Survey and also South 1,569 feet and East 3,021 feet from the northwest corner of said James F. MAIN SURVEY TRACT '~f-__ 1-B, 6000 BLOCK ON RANDOL MILL ROAD ''' ( V-90-12 ) RECOMMENDATION: INI'9TRATIDIMI It is recommended that the City Council adopt an ordinance vacating a 1,165 s"'P~~'~' long strip of variable width right-of-way in the 6000 block of Randol Mill Road, located within Tract 2-H, James F. Redding Survey, Abstract 1302, and Tract 1-B, G. W. Main Survey, Abstract 1097, as recommended by the City Plan Commission. DISCUSSION: As part of the settlement of a condemnation case, between the City and Daon-Texas, owner of the adjacent property, the City agreed to vacate the street right-of-way as shown on the attached map and field notes. The subject street, acquired by prescription, has been reconstructed. The new alignment makes this portion of the old Randol Mill Road right-of-way excess property. This vacation request establishes a new property line between the new right-of-way for Randol Mill Road and the adjacent property owner. The area of the right-of-way to be vacated contains no utility facilities. The settlement agreement of the condemnation case requires no fee to be charged for the vacation of this street right-of-way. Reviewing City departments and private utility companies have raised no objection to this request. The City Plan Commission has approved the vacation of this street right-of-way without the requirement for replat until the time the property is developed.
