ORDINANCE N0.
AN ORDINANCE LNCREASING THE ESTIMATED RECEIPTS IN THE FORT
WORTH POLICE AWARDED ASSETS, SPECIAL TRUST FUND FE 72,
CENTER 035535000000 OF THE CITY OF FORT WORTH FOR FISCAL
YEAR 1990-1991 BY $97,370.00 AND APPROPRIATING SAID AMOUNfi
TO THE FORT WORTH POLICE AWARDED ASSETS, SPECIAL TRUST
FUND FE 72, CENTER 035535000000 FOR THE PURPOSE OF
PROVIDING FUNDS FOR THE RENOVATION OF THE POLICE
DEPARTMENT, WEST DIVISION BUILDING, PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN
CONFLICT HEREWITH; PROVIDING FOR ENGROSSMENT AND
ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS.
SECTION 1.
That in addition to those amounts allocated to the various City departments
for the Fiscal Year 1990-91 and in the Budget of the City Manager, there
shall also be increased estimated receipts in the Fort Worth Police Awarded
Assets, Special Trust Fund, FE 72, Center 035535000000 by the sum of
$97,370.fl0 and appropriating said $97,370 00 to the Fort Worth Police Awarded
Assets, Special Trust Fund, FE 72, Center 035535000000 for the purpose of
providing funds for the renovation of the Police Department, West Division
Building.
SECTION 2
Should any portion, section or part of a section of this ordinance be
declared invalid, inoperative or void for any reason by a court of competent
jurisdiction, such decision, opinion or judgement shall in no way impair the
remaining portions, sections, or parts of sections of this ordinance, which
said remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No 10652 and all other
ordinances and appropriations amending the same except in those instances
where the provisions of this ordinance are in direct conflict with such other
ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
The City Secretary of the City of Fort Worth is hereby directed to engross and
enroll this ordinance by copying the caption and effective date into the
minutes of the City Council and by filing this ordinance in the ordinance
records of the City of Fort Worth.

SECTION 5.
This ordinance shall take effect and be in full force and effect from and
after the date of this passage, and it is so ordained.

RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to:
1. adopt the attached appropriations ordinance increasing estimated
receipts and appropriations by $97,370 in Special Trust Fund FE 72,
Center 035535000000, FTW Police/Awarded Assets, from increased
revenues.

3. execute a contract for construction of the West Police Sector
Renovation to E. Horn Construction, Inc., 819 Penn, Fort Worth, for
$253,370 including the base bid and Alternate No. 1.
BACKGROUND•
On December 5, 1989 (M&C C-12024), the City Council approved a contract with
Shutts, Magee & Riddle to provide the necessary professional services for
design of the project for a fee of $20,500.
Plans,and} specs-fications were completed and approved in July, 1990. The
projectrwa's advertised on July 26 and August 2, 1990.
Base bid includes interior renovation of the existing building. Alternate
No. 1 includes enclosing the existing loading -dock for an exercise space.
RECEIPT OF BIDS:
On August 16, 1990, eleven contractors submitted bids on the project as
follows:

The low bidder, E. Horn Construction, Inc. is below the budget estimate of
$245,000 for the base bid. The recommendation is to award the total project.
However, the available funds are not sufficient to award the total project
and fund the testing, inspections, telephones, furniture and fixtures. Total
estimated budget is $365,870. Therefore, it is recommended that the
shortfall of $97,370 be financed from the Police Department's Seized Assets
Fund.
E. Horn Construction, Inc. has complied with the requirements for
disadvantaged business enterprises participation in City contracts.
FINANCING:
Sufficient funds are available to transfer from Special Trust Fund FE 72,
Center 035535000000, FTW Police/Awarded Assets and Public Safety
Improvements Fund GC07, Center 036070115000, West Police Sector Renovations.
Upon approval and completion of recommendations 1 & 2, sufficient funds will
be available in Public Safety Improvement Fund GC07, Center 020070115000,
West Police Sector Renovations. Expenditure will be made from Account No.
541200.
