1. _ ~., ORDINANCE NO . ~Ol~~~ AN ORDINANCE AMENDING THE FORT WORTH PLUMBING CODE, CODIFIED A5 CHAPTER 26 OF THE CODE OF THE CITY OF FORT WORTH (1986 ) , AS AMENDED , BY REVISING SECTION 2b-2 ( C ) "INSTALLATION RE©UI'REMENTS" REGARDING "MATERIALS", PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES, PROVIDING FOR A PENALTY CLAUSE, PROVIDING FOR A SAVING CLAUSE, PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING FOR ENGROSSMENT AND ENROLLMENT, PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS• SECTION 1. That Section 2b-2(c) of the Code of the City of Fort Worth (1986), as amended, is hereby amended by amending Section 401 to read as follows- Section 401 - Materials (a) Drainage piping shall be cast iron, galvanized steel, galvanized wrought iron, lead capper, brass, ABS, PVC, extra strength vitrified clay pipe, or at her approved materials having a smooth and uniform bore, except that (1)No galvanized wrought iron or galvanized steel pipe shall be used underground and shall be kept at least s i x (b) i nches (152 4 mm) above ground (2) ABS and PVC DWV piping installations shall. be limited to those structures where combustible construction is allowed (3) No vitrified clay pipe or fittings shall be used above ground or where pressurized by a pump or ejector They sha 11 be kept at 1 east t we 1 ve (12) i nches ( 3m) be 1 ow ground. (b) Drainage fittings shall be of cas~ iron, mallebable iron, lead, brass, copper ABS, PVC, vitrifi d clay, or other approved materials having a smooth interior waterway of the same diameter as the piping served and all such fittings shall conform to the type of pipe used (1) Fittings on screwed pipe shall be of the recessed drainage type burred ends shall be reamed to the full bore of the pipe. 1 v 'S. h ~'° n (2) The threads of drainage fittings shall be tapped so as to allow one fourth (1/4) inch per foot (20.9 mm/m) grade SECTION 2 That Section 26-2(c) of the Code of the City of Fort Worth (198b), as amended, is hereby amended by amending Section 503 to read as follows: Section 503 - Materials (a) Vent pipe shall be cast iron, galvanized steel, galvanized wrought iron, lead, copper, brass, ABS, PVC or other approved materials, except that: (1) No galvanized wrought iron or galvanized steel pipe shall e used underground and shall be kept at least six (b ) inches above ground (2) ABS and PVC DWV piping installations shall be limited to those structures where combustible construction is allowed. (b) Vent fittings shall be cast iron, galvanized malleable iron or galvanized steel, lead, copper, brass, ABS, PVC, or other approved materials except that no galvanized malleable iron or galvanized steel fittings shall be used underground and shall be kept at 1 east s i x ( b) ,i nches (152 .4mm) above ground . (c) Changes in direction of vent piping shall be made by the appropriate use of approved fittings and no such pipe shall be strained or bent Burred ends shall be reamed to the full bore of the pipe. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinances are severable, and if any phrase, clause, sentence, paragraph ar section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and section of this ordinances, since the same would have been enacted by the City Council without the incorporation 2 ~. , in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4 All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Chapter 26 of the Code, or any other ordinances affecting plumbing which have accrued at the time of the effective date of this ordinance, and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinance, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts SECTION 5 The City Secretary of the City of Fort Worth, Texas, is hereby authorized to publish this ordinance in pamphlet farm for general distribution among the public, and the operative provision of this ordinances as so published shall be admissible in evidence in all courts without further proof than the production thereof, as provided in Chapter XXV, Section 3, of the Charter of the City of Fort Worth, Texas. SECTION 6. Three (3) copies of the 1985 Uniform Plumbing Cade, together with the local amendments contained in this ordinance, shall be filed in the office of the City Secretary for permanent record and inspection. 3 1: a , SECTION 7. Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not to exceed Two Thousand Dollars 02000 00) for all violations involving fire safety or public health and sanitation and shall be fined not more than Five Hundred Dollars 0500.00) far all other violations of this ordinance Each day or any portion thereof during which any violation of this ordinance occurs or continues shall be deemed a separate offense and upon conviction thereof shall be punishable as herein provided. SECTION 8 The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and Sections 1, 2, 7, 9, and 10 of this ordinance in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECTION 9. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption and Sections 1, 2, 7, 9, and 10 of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by V.T.C.A Local Government code Section 52.013 SECTION 10 This ordinance shall be in full force and effect from and after is passage and publication as required by law, and it is so 4 .. n:.. . ~: ;~. ordained. Delete Sections 401 and 503 from the Fort Worth local amendments and adopt Sections 401 and 503 of the 1985 Uniform Plumbing Code as written (see attachment); and 2. This change makes the Plumbing Code compatible with the Building Code regarding combustible construction and allows plastic combustible plumbing materials in all types of construction. Previous local amend- ment wording prevented use of plastic combustible plumbing in Types I, II F-R and II one hour construction.
