ORDINANCE `NO ~~
AN ORDINANCE APPROPRIATING $20,000.00 TO THE GENERAL FUND 01,NON-DEPARTMENTAL ACCOUNT NO
90-55-00, AND DECREASING THE UNRESERVED, UNDESIGNATED FUND BALANCE OF THE GENERAL FUND 01 BY
THE SAME AMOUNT FOR THE PURPOSE OF COMPENSATING CONSULTANTS FOR WORK RELATED TO AIR QUALITY
ISSUES, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, PROVIDING FOR ENGROSSMENT
AND ENROLLMENT, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for the Fiscal Year
1989-90 and in the Budget of the City Manager, there shall also be increased appropriations in the
General Fund 01, Non-Departmental Account No 90-55-00, in the amount of $20,000 00, thereby
decreasing the unreserved, undesignated fund balance by the same amount for the purpose of
compensating consultants for work related to air quality issues
SECTION 2
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative
or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall
in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said
remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No 10363 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are
in direct conflict with such other ordinances and appropriations, in which instance said conflicting
provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4
The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this
ordinance by copying the caption and effective date into the minutes of the City Council and by filing this
ordinance in the ordinance records of the City of Fort Worth
SECTION 5
This ordinance shall take effect and be in full force and effect from and after the date of its
passage, and it is so ordained

It is recommended that the City Council
1. Adop'G the attached supplemental appropriations ordinance increasing
appropriations by $20,000 in General Fund O1, Non-Departmental Account
No. 90-55-00 and decreasing by the same amount the Unreserved, Undesig-
nated.Fund Balance of the General Fund O1 for the purpose of compensat-
ing:consultants for work related to the air quality issues, and
2. Authorize the City Manager to increase City Secretary Contract No. 17310
with-Ned K. Burleson and Associates, Inc. for outside consultation on
air-quality issues by $20,000 for a total amount not to exceed $35,000.
•~ DISCUSSION
~
On June 1,3, 1989 (M&C C-11707), the City Council authorized the City ~1anager
to contract with Ned K. Burleson and Associates, Inc. to assist and advise
the City in matters related to amendments to the Clean Air Act, implementa-
tion programs as required in the corrected State Implementation Plan, cost
associated with implementing new control strategies, and the attainment of
the air quality standards while continuing to have economic growth within the
City. The compensation to be paid to Burleson and Associates for these ser-
vices was fixed at an amount not to exceed $15,000.
At the time the original contract was proposed, the City anticipated Congress
would amend the Clean Air Act prior to October 1, 1989. While several bills
were introduced, the Administration Bill has emerged as the vehicle for amend-
ing the Clean Air Act by early spring 1990. There also has been some develop-
ment in controlling mobile sources, which are believed to be the primary
source for carbon monoxide and ozone non-attainment in the major metropolitan
cities.
Because Burleson and Associates has experience in air quality issues relating
to control measures and their cost effectiveness as well as their experience
in legislative history on the Clean Air Act, it is recommended that Burleson
and Associates be retained to assist the City in reviewing the amendments to
the Clean Air Act, developing a new State Implementation Plan, and reviewing
the cost associated with controls and the potential impact on the economic
growth within the City.
FINANCING
Upon approval of Recommendation No. 1, sufficient funds will be available in
General Fund O1, Non-Departmental Account No. 90-55-00, Consultant Fees, in
the amount of $20,000. Expenditures will be charged to Index Code 328005.
