HomeMy WebLinkAboutOrdinance 10762~ a h ORDINANCE N0. / ~ C~ AN ORDINANCE ADOPTING A LOCAL AMENDMENT TO SECTION 2.106 OF THE UNIFORM FIRE CODE OF 1988, BY AMENDING SUBSECTION (b), "FIRE CODE," OF SECTION 13-2, ARTICLE I, CHAPTER 13, "FIRE PREVENTION AND PROTECTION" OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (1986), AS AMENDED, TO PROVIDE APPROPRIATE AUTHORIZATION FOR PERSONNEL OF THE POLICE DEPARTMENT AND OF THE CODE ENFORCEMENT DIVISION OF THE DEPARTMENT OF CITY SERVICES TO ENFORCE PROVISIONS OF THE FIRE CODE OF THE CITY OF FORT WORTH; PROVIDING A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; ' PROVIDING FOR ENGROSSMENT AND ENROLLMENT OF THIS ORDI- NANCE; PROVIDING FOR PUBLICATION OF THIS ORDINANCE IN A NEWSPAPER OF GENERAL CIRCULATION; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. Subsection (b), "Fire Code," of Section 13-2, "Same - Amendments," of Article I of Chapter 13 of the Code of the City of Fort Worth, Texas (1986), as amended, is hereby further amended by inserting a new Section 2.106, constituting a local amendment to the Uniform Fire Code of 1988, between Section 2.105 and Section 2.201, said new Section 2.106 to read as follows: Sec. 2.106. Authority of Police and Code Enforcement Personnel to assist in enforcing this Code. Whenever requested to do so by the Fire Chief or his authorized representative, the Chief of Police may assign such police personnel, and the Director of City Services may assign such code enforcement personnel, as may be deemed necessary to assist the Fire Department in enforcing the provisions of this Code. -~-~. ,- SECTION 2. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 3. This ordinance shall be cumulative of all provisions of ordi- nances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption in the minutes of t'he City Council and by filing the ordi- nance in the ordinance records of the City. SECTION 5. The City Secretary of the City of Fort Worth, Texas, is here- by directed to publish the caption of this ordinance for two (2) 2 - .r° ~: ~ . DISCUSSION: Efforts to correct safety hazards in certain structures has resulted in a duplication of effort requiring both the Fire Department and Code Enforcement inspectors to document the same violations. Additionally, due to recent budget reductions in the Fire Department and ensuing personnel reductions, the department no longer routinely inspects vacant and open structures. The recommended amendment to the Uniform Chief, in cooperation with the Director of inspection responsibilities to the Code amendment is approved, the Fire Chief wou Division to enforce provisions of the Fire structures.
