FOR THE REMOVAL AND DISPOSAL OF ASBESTOS IN THE WILL ROGERS MEMORIAL AUDITORIUM AND ENTERING INTO A CONTRACT WITH MICROANALYSIS LABORATORIES TO PERFORM THE NECESSARY INDUSTRIAL HYGIENE AND THIRD-PARTY OVERSIGHT FUNCTIONS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,~TEXAS: ,. SECTION 1. That in addition to those amounts allocated to the various City departments for the Fiscal Year 1990-91 and in the Budget of the City Manager, there shall also be increased appropriations in the General Fund GGO1, Non-Departmental Account No. 539120, Environmental Management Contracts, Center No. 0906601 in the amount of $320,000.00; thereby decreasing the unrestricted, undesignated Fund Balance by the same amount, for the purpose of providing funds to enter into a contractual agreement with U.S. Environmental Services, Inc. for the removal and disposal of `asbestos in the Will Rogers Memorial Auditorium and entering into a contract with Microanalysis Laboratories to perform the necessary industrial hygiene and third-party oversight functions SECTION 2 Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court or competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 10652 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. The City Secretary of the City of Fort worth is hereby directed to engross and enroll this ordinance by copying the caption and effective date into the minutes of the City Council and by filing this ordinance in the ordinance records of the City of Fort Worth SECTION 5. Authorize the City Manager to enter into a contract with U.S. Environ.- mental Services, Inc., a local firm, for the removal and disposal-.:-ofT asbestos in the Will Rogers Memorial Auditorium and the clean-ups of all asbestos contaminated surfaces for an amount not to excee~dj_, $274,000; and enter into a contract with Microanalysis Laboratories, a local DBE firm to perform the necessary industrial hygiene~~and~~ third-party oversight functions for an amount not to exceed $46,000.--. DISCUSSION In October, 1990, staff was informed of friable asbestos contamination in the Will Rogers Memorial Auditorium. Due to the potential health hazards, the urgency of the situation precluded advertisement for competitive bids. Price proposals for asbestos abatement were requested from 3 firms: U. S. Environmental $274,635.00 EmTech $361,706.00 RemCon, Inc. $319,820.00 ' U.S. Environmental presented the lowest bid. In order to satisfy the DBE requirements and ensure the integrity of third-party oversight on the pro- ject, the City will act as its own general contractor and contract to U.S. Environmental Services, Inc. for abatement activities, and to Microanalysis Laboratories, a DBE firm, for the industrial hygiene oversight activities. FINANCING Upon approval and completion of Recommendation No. 1, sufficient funds will be available in General Fund GGO1, Center No. 0906601, Contracts Administra- tion. Expenditure will be made from Account No. 539120. The Unreserved, Undesignated General Fund Balance will be 23,000,441 upon comppletion of this transfer. APPROVED BY CITY CCU~C~~.
