ORDINANCE N0. d AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING THE EXCESS PORTION OF A STREET RIGHT-OF-WAY LOCATED WITHIN THE SOUTHSIDE ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the excess right-of-way at the southwest corner of the intersection of West Seminary Drive and Hemphill Street, located within Lot 2, Block 10, Southside Addition, as recorded in Volume 204-A, Page 109, P.R T.C.T., and as more specifically described in attached Exhibit "A", attached hereto and incorpo- rated herein, be and the same is vacated, abandoned and perma- nently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated excess street right-of-way is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that ease- ments are retained for any and all existing and prospective utilities. SECTION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. DISCUSSION: Mr. Bob Pearce, representing Phillips 66 Company, the owners of the property, requested that the City vacate the above-described portion of a street right- of-way. This portion of the subject street was acquired by dedication and is undeveloped parkway. There are no utility facilities located within the area to be vacated. The vacation request has been made in order to replat this area for development purposes. Reviewing City departments and private utility companies have raised no objection to this request. A satisfactory replat has been submitted. The Land Agent for the City of Fort Worth has determined that a $1,715 00 fee satisfies the interest of the City in this public right-of-way.
