ORDINANCE NO . ~ ~~~~
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING (I) A PORTION OF A STREET RIGHT-OF-WAY AND
(II) A UTILITY EASEMENT; PROVIDING FOR REVERSION OF FEE
IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HERE-
WITH; AND PROVIDING AN 'EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
THAT the following street right-of-way and utility easement,
each as more specifically described in attached Exhibit "A",
attached hereto and incorporated herein, be and the same are
vacated, abandoned and permanently closed and extinguished:
1) The west one hundred twenty (120) foot portion of the
street right-of-way of Bertha Avenue, including a forty
(40} foot radius turn-around easement located in the
remainder of Lot
recorded in Volume
Block 9, and Lot
recorded in Volume
unplatted parcel
G. J. Ashabranner
1, Block 1, Echols Addition, as
388-54, Page 21, P.R.T.C.T., Lot 15,
Block 12, B. Jackson Addition, as
388-Q, Page 161, P.R.T.C.T., and an
of land identified as Tract 3-A,
Survey, Abstract 7, Tarrant County,
Texas; and
2) The five (5) foot wide by four hundred fifty-four point
fifteen (454.15) foot long utility easement located in
Lot 1, Block I, Echols Addition, as recorded in
Volume 388-54, Page 21, P.R.T.C.T.
SECTION 2.
That the fee to the land in the above described vacated
street right-of-way and utility easement is hereby released and
shall revert to the adjacent owner as provided by law, SAVE AND
EXCEPT that easements are retained for any and all existing and
prospective utilities in the above described vacated street
right-of-way
SECTION 3.
That all ordinances or parts of ordinances in conflict here-
with are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force
and effect from and after the date of its passage, and it is so
ordained.

Description of a 5.0 Foot Wide Utility
Easement to be Vacated.
0.0521 of an acre of land situated in Lot 1 Block 1, Echols
Addition to the City of Fort Worth, Texas as recorded in
Volume 388-54, Page 21, Plat Records of Tarrant County, Texas
said 0.0521 of an acre of land beiny an easement 5.00 feet in
width, 2.50 feet each side of and parallel to the following
described centerline:
BEGINNING at a point N 89° 48' 00" W, 2.50 feet and N 00° O1'
00" E, 193.76 feet from the southeast corner of Lot 1 Block 1
Echols Addition.
THENCE S 00° O1' 00" W, 191.26 feet;
THENCE N 89° 48' 00" W, 262.89 feet to the end of said
easement and containing 2,271 square feet or 0.0521 of an acre
of land .

RECOMMENDATION:
It is recommended that the City Council adopt an ordinance vacating the west
120' of Bertha Avenue, including a 40' radius turn-around easement located in
the remainder of Lot 1, Block i, Echols Addition, as recorded in Vol. 388-54,
Page 21, P.R.T.C.T.; Lot 15, Block 9, and Lot 1, Bock 12, B. Jackson Addition,
and an unplatted parcel of land identified as Tract 3-A, G. J. Ashabranner
Survey, Abstract 7, Tarrant County, Texas and a 454.15' long by 5' wide utility
easement located in Lot 1, Block 1, Echols Addition, as recommended by the City
Plan Commission.
DISCUSSION:
Mr. Art Thompson, President of the YMCA, which owns all of the adjacent
property, has requested that the City vacate the above-described portion of a
street right-of-way and utility easement.
This portion of the subject street and utility easement, acquired by
dedication, is either undeveloped excess parkway or utility easement. There
are no utilities located in the right-of-way or easement. The vacation request
has been proposed in order to replat the vacated right-of-way and utility
easement with the adjoining land for development purposes.
The Land Agent for the City of Fort Worth has determined that a $100.00 fee
satisfies the interest of the City of Fort Worth in this public right-of-way.
Reviewing City departments and private utility companies have raised no
objection to this request. A satisfactory replat has been submitted.
