HomeMy WebLinkAboutOrdinance 10402, Attachment to M&C G-8227 ORDINANCE NO __!~~~~~~ AN ORDINANCE REPEALING ORDINANCE N0. 9730 OF THE CITY OF FORT WORTH, BEING CHAPTER 20, ARTICLE VIII ("SOLICITATIONS"), SECTIONS 20-336 THROUGH 2O-351 OF THE CODE OF THE CITY OF FORT WORTH, TEXAS, AS AMENDED; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGR05S- MENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. Ordinance No 9730, codified at Chapter 20, Article VIII ("Solicitations"), Sections 20-336 through 20-351 of the Code of the City of Fort Worth, Texas (1986), as amended, is hereby repealed and is of no further force and effect. SECTION II. This ordinance shall be cumulative of all provisions of ordi- nances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION III. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstituticnal by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, para- -. graphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sen- tence, paragraph or section. SECTION IV. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the cap- tion and Section V in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECTION V. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. DISCUSSION: During the 1989-90 budget process for the City's General Fund, all depart- ments were asked to reduce any funding not completely necessary as a service function. Although the registration of charitable organizations does provide a public service, the administrative costs appear to be excessive for the benefit derived. As a result, the Department of Housing and Human Services recommends that the registration requirement be eliminated and that the ordinance establishing the Charitable Solicitations Review Board be repealed. This decision was also based on the fact that recent Supreme Court decisions have given charities virtually an absolute right to solicit free from governmental restraints. The members of the Charitable Solicitations Review Board approved by concensus the recommendation to repeal Ordinance 9730 at their July 28th meeting.
