ORDINANCE N0. `~ I D
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING A PORTION OF WEST MORNINGSIDE DRIVE, AS MORE
SPECIFICALLY DESCRIBED BELOW, BEING LOCATED WITHIN THE
BLANCHARD ADDITION OF THE CITY OF FORT WORTH, TEXAS;
PROVIDING FOR REVERSION OF FEE IN SAID LANDS}; REPEAL-
ING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
THAT the portion of West Morningside Drive, measuring three
hundred sixty-nine feet in length and varying in width, and
located between Lot 5R and Lot 6, Block 2 of the Blanchard
Addition to the City of Fort Worth, Texas, as recoraea in
Volume 388-48, Page 615 of the Plat Records of Tarrant County,
Texas, be and the same is vacated, abandoned and permanently
closed and extinguished.
SECTION 2.
That the fee to the land in the above described vacated pub-
lic street and right-of-way is hereby released and shall revert
to the adjacent owner as provided by law, SAVE AND EXCEPT that
easements are retained for any and all existing and prospective
utilities, including but not limited to the existing sanitary
sewer line.
SECTION 3.
That all ordinances or parts of ordinances in conflict here-
with are hereby repealed

SECTION 4.
That this ordinance shall take effect and be in full force
and effect from and after the date of its passage, and it is so
ordained.

RECOMMENDATION
It is recommended that the City Council adopt an ordinance vacating a portion
of West Plorningside Drive, measuring 369' long and of variable width, and
located between Lot 5R and Lot 6, Block 2, Blanchard Addition, as recorded in
Vol. 388-48, Page 615, P.R.T.C.T., as recommended by the City Plan
Commission.
DISCUSSION
Thomas E. Dobson, Vice President of Whataburger, Inc., owner of the subject
property, has requested that the City vacate the above described street
right-of-way (reserved for further expansion of West P~orningside Drive) as
shown on the attached map.
The subject street right-of-way, acquired by dedication, is not open on the
ground but does contain a City sewer line that serves the adjacent property.
Satisfactory arrangements have been made with the Water Department relative
to the retention of this sewer line. This vacation request is being made in
order to improve the vacated right-of-way as part of the replat of this
property for the construction of the Whataburger facility.
The Land Agent for the City of Fort Worth has determined that no monetary
consideration for the vacation and transfer of this public right-of-way is
necessary.
Reviewing City departments and private utility companies have raised no
objection to this request. A satisfactory replat has been submitted.
