HomeMy WebLinkAboutOrdinance 10413:r ~ j, ., -~,~ ~ ; M ~ ~ ~ ..~ ~, ' ORDINANCE NO. /_ ~'~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING CERTAIN STREET AND ALLEY RIGHTS-OF-WAY, AS MORE SPECIFICALLY DESCRIBED HEREIN, LOCATED WITHIN THE FORT WORTH ORIGINAL TOWN ADDITION AND THE DAGGETT ADDITION, BOTH IN FORT WORTH, TARRANT COUNTY, TEXA5; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the portions of Elm Street, Luella Avenue, East 11th Street, East 14th Street, and East 15th Street, as more particu- larly described in Exhibit "A" which is attached hereto and incor- porated herein by reference for all purposes, and being located in Fort Worth Original Town Addition to the City of Fort Worth, Texas, and the Daggett Addition to the City of Fort Worth, Texas be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated pub- lic street and alley rights-of-way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. APPROVED AS TO FORM AND LEGALITY: G~~%UG/' Assistant City At rney Date : ~ as ADOPTED• EFFECTIVE: ~~ 2 FIELD NOTES OF PARCELS TO BE VACATED Portions of streets and alleys lying in a 16.8296 acre tract comprising portions of the following: Blocks N-1, H-1 through H-3, I-2 and I-3, Daggetts Addition to the City of Fort Worth, Tarrant County, Texas, and also City Blocks 131 through 138, 144 and 145 of the Original Town of Fort Worth, said parcels to be vacated are portions of streets for which no records of closing ordinances were found effecting closure or abandonment of said streets. The POINT OF COMMENCEMENT far all following described tracts is an iron pin found at the northwest corner of City Block 144, said point of commencement being at the intersection of the south line of former Morgan Street with the east line of former Pecan Street, and also being the Point of Beginning of a 16.8296 acre tract surveyed by J.M. At.ANNIN0.1 WwaT DATE REFERENCE SUBJECT VACATION OF A STREET AND ALLEY PAGE NUMBER RIGHTS-OF-WAY FORT WORTH ORIGINAL 1 10-3-89 **PZ-1560 TOWN BLOCKS 133 134 135 137 138 '°` 144, AND 145, DAGGETT ADDITION, BLOCKS I-2 AND I-3, PORTIONS OF ELM STREET, LUELLA AVENUE, EAST 11TH STREET, EAST 13TH STREET, AND EAST 15TH STREET (V-87-12-R) RECOMMENDATION It is recommended that the City Council adopt an ordinance vacating a portion of Elm Street, Luella Avenue, East 11th Street, East 14th Street, and East 15th Street, located in Block 133, 134, 135, 137, 138, 144 and 145 of Fort Worth Original Town and Blocks I-2 and I-3, Daggett Addition, all embracing portions of tracts recorded in Volume 291, Page 267, D.R.T.C.T., Volume 491, Page 639, D.R.T.C.T., and Uolume X, Page 274, D.R.T.C.T., as recommended by the City Plan Commission. DISCUSSION Mr. Barry Hudson, consultant, and representing Glacier Park Company, owner of all abutting property, has requested that the City vacate the above described street rights-of-way as shown on the attached map and further described in the attached field notes. The subject street rights-of-way, acquired by dedication, are not open on the ground and do not control any utilities. The subject vacation request is being made in order to include the vacated rights-of-way as part of the railroad property. The Land Agent for the City of Fort Worth has determined that no monetary consideration for the vacation and transfer of these public rights-of-way is necessary due to the dedication of additional property to the City of Fort Worth in exchange for these rights-of-way.
