HomeMy WebLinkAboutOrdinance 10320w^P ORDINANCE N0. ©~~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING A PORT TON OF MENZER ROAD, A PUBLIC STREET '~ RIGHT-OF-WAY, AS MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING FOR RETENTION OF UTILITY EASEMENTS; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 . That the twenty (20) foot wide by one hundred five (105} foot long portion of Menzer Road, located adjacent to Lot 5 and the remaining portion of Lot 21, Benmar Grove Addition, as re- corded in Volume 976, Page 635, Plat Records, Tarrant County, Texas, be and the same is vacated, abandoned and permanently closed and extinguished as a public street right-of-way. SECT ION 2 . That the fee to the land in the above described vacated pub- lic street right-of-way is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that ease- ments are retained for any and all existing and prospective utilities, including but not limited to existing water and sewer utility faciltiies. SECTION 3 . That all ordinances or parts of ordinances in conflict here- with are hereby repealed. . ~~ -w ~;~ - SECT ION 4 . That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. DISCUSSION: Mr. Charles D. Barnett, owner of all;?adjacent property, has requested that the City Council vacate the above described street right-of-way as shown on the attached map. ' The subject street right-of-way is unimproved, but does contain water and sewer utility facilities. Appropriate arrangements have been made to provide utility easements for these utility facilities. The subject vacation request is being made in order to include the vacated right-of-way as part of the adjacent property. The required and appropriate monetary consideration, one hundred dollars ($100.00), has been placed in escrow with the Real Property Department as required by the Land Agent for the City of Fort Worth. Reviewing City departments and private utility companies have raised no objection to this request, subject to the vacated right-of-way being replatted with adjacent property. A satisfactory replat has been submitted.
