AMENDING CHAPTER 25, "PLANNING'°, OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (1986), BY AMENDING SECTION 25-1 THEREOF, TO INCREASE THE FEES FOR CER'T'AIN APPLICATIONS kELATED TO THE: FILING OF PLATS WITH THE PLANNING COMMISSION; PROVIDING FOR THE REPEAL OF ORDI- NANCES AND OF COllE SECTIONS ILV CONFLICT HEREWITH; PROVID- ING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF OTHER ORDI- NANCES AND CODE SECTIONS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENKOLLMENT; ANU PROVIDING AN EFFhCTIVE DATE. WHEREAS, by order of the 'Tarrant County Commissioner's Court, Order No. 61000, dated November 28, 1988, effective January 1, 1989, the fees for the filing of plats with the County Cler}c have been increased considerably; and WHEREAS, the City of Fort Worth has on file with it a consider- able number of plats in various stages of review which it will be required to file after January 1, 1989; and WHEREAS, the current fee charged by the Development Department includes a nominal amount to cover present filing costs but is in- sufficient to cover the major increases approved by Tarrant County; and WHEREAS, the City of Fort Worth will be forced to bear the cost of this increase unless it is passed on to the applicants; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. The fee increases in this ordinance with respect to plats required to be filed with the County Clerk shall apply to all plats filed with the County Clerk after December 31, 1983. -3- ' ., q . i ~r SECTION 3. This ordinance shall be cumulative of all provisions of ordi- nances and of the Code of the City of Fort iNorth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sectians of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and Sections ~, L ~.~~~ ~ in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. -~4- F~z. < ~..
