HomeMy WebLinkAboutOrdinance 18847-09-2009Ordinance No.188~7-09-2009 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PARK GAS LEASE PROJECT FUND IN THE AMOUNT OF $195,702.75, FROM GAS WELL ROYALTY REVENUES, FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE GENERAL FUND; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN GONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2008-2009 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Park Gas Lease Project Fund in the amount of $195,702.75, from gas well royalty revenues, for the purpose of transferring said funds to the General Fund. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 18283 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Park Gas Lease Project Fund by $195,702.75 from gas well royalty revenues; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the CIP Parks & Community Services Improvement Fund by $27,776.00 from available funds; and 3. Authorize the transfer of $195,702.75 from the Park Gas Lease Project Fund to the General Fund ;and 4. Authorize the transfer of $27,776.00 from the CIP Parks & Community Service Improvement Fund to the General Fund; and 5. Adopt the attached appropriation ordinance increasing estimated receipts by $223,478.75 in the General Fund. Garden Center. was completed it February and f~larc~h of 2GC9 These improvements ~:a~ere made irk .orr.~er In 2007, the United States Congress passed the Virginia Graeme Baker Paol and Spa Safety Act of 2007. The Act mandated that all pool and spa drains have anti-entrapment drain covers to prevent accidental drowning due to entrapment. The Act took effect on December 19, 2008, at which time ali pools were required to have new drain covers or certification of existing drain covers by an engineer to ensure that the drains met the requirements of this new federal law. The City's seven outdoor swimming pools, which are located at: Forest Park, Sylvania Park, Sycamore Park, Marine Park, Hillside Park, Kellis Park, and Lake Como Park, required the following improvements in order to open for the Summer 2009 season: replacement of a total of (13}drain covers and certification of four existing drain covers. The pools at Marine, Sylvania, and Sycamore Parks each have three main drains that required new covers (nine total}. The pools at Hillside and Kellis Parks each have one main drain each that required covers (two total}. The Lake Como Park pool has two main drains that required covers (two total}. All pool drain covers were installed by City staff at a total cost of $7,050.00. The Forest Park pool has four main drains. Due to the PVC pool liner, the City sought certification by C.T. Brannon Corp. for the existing drain covers at a total cost of $979.75. All pool drain work was completed by May 22, 2009 for a total cost of $8,029.75. The General Fund will be reimbursed for these costs using gas well royalty revenue. On August 18, 2009, the City Council approved the purchase of a specially equipped 26,000 GVW flat bed truck fitted with an articulated four section crane (M&C P-11021 }. The unit will be used to handle fallen trees and root balls that are potential safety hazards and to plant new trees. This vehicle will replace a 1983 model articulating crane truck that is frequently out of service. This is an eligible purchase within the gas well expenditure criteria because the equipment has a minimum ten year useful life. The cost of the vehicle was $138,880.00. Gas well royalty revenue in the amount of $111,104.00 from the Park Gas Lease Project Fund and revenue from the CIP Parks and Community Service Improvement Fund in the amount of $27,776.00 (fines collected for violating the Tree Preservation Ordinance and mitigation funds} will be used to reimburse the General Fund for this cast. The use of gas well revenues derived from mineral leases on dedicated parkland to fund these legal mandates and equipment replacement purchase is in accordance with the Gas Well Revenue Distribution Financial Management Policy. The Deborah Beggs Moncrief Botanic Garden Center and the Gardens Restaurant are located in COUNCIL DISTRICT 7 and benefit the entire city. Forest Park pool is located in COUNCIL DISTRICT 9; Sylvania Park pool is located in COUNCIL DISTRICT 4; Sycamore Park pool is located in COUNCIL DISTRICT 8; Marine Park pool is located in COUNCIL DISTRICT 2; Hillside Park pool is located in COUNCIL DISTRICT 8; Kellis Park pool is located in COUNCIL DISTRICT 3; Coma Park pool is located in COUNCIL DISTRICT 7.
