HomeMy WebLinkAboutOrdinance 10337 r f ,:. t. ~. l %~ °~ ORDINANCE NO. _ 1-D~!v~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS IN THE GENERAL FUND, FUND O1, POLICE, DEPARTMENT, SPECIAL OPERATIONS DIVISION, IN THE AMOUNT OF $6,900, AND APPROPRIATING SAID AMOUNT TO THE GENERAL FUND O1, POLICE DEPARTMENT, SPECIAL OPERATIONS DIVISION, ACCOUNT NO 35-44-00, THEREBY INCREASING APPROPRIATIONS IN THE GENERAL FUND O1, BY THE SAME AMOUNT FOR THE PURPOSE OF PURCHASING 9MM SEMIAUTOMATIC PISTOLS AND HOLSTERS FOR FEDERAL TASK FORCE OFFICERS, PROVIDING FOR A SEVERABILTTY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, PROVIDING FOR ENGROSSMENT AND ENROLLMENT, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1. That in addition to those amounts allocated to the various City departments for the Fiscal Year 1989 and in the Budget of the City Manager, there shall also be increased estimated receipts in the General Fund O1, Police Department, Special Operations Division, in the amount of $6,900, and appropriating said amount to the General Fund O1, Account No 35- 44-00, thereby increasing appropriations in the General Fund O1, by the same amount for the purpose of purchasing 9mm semiautomatic pistols and holsters for the Federal Task Force Officers SECTION 2 Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That thi s ordinance shall be cumulative of Ordinance No 10151 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross. and enroll this ordinance by copying the caption and effective date into the minutes of the City Council and by filing this ordinance in the ordinance records of the City of Fort Worth. SECTION 5 This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. FORCE OFFICERS ' °f RECOMMENDATION It is recommended that the City Council 1. Approve $6,900 of income earned from restitution payments, sales and auctions, refunds and recoveries of drug related cash and equipment, to be deposited in General Fund O1, 4 2. Adopt the attached supplemental appropriations ordinance increasing the General Fund O1 estimated receipts by $6,900 and appropriations by a like amount in the Police Department Special Operations Division Account No. 35-44-00, and 3. Authorize $6,900 be used to purchase 9mm semiautomatic pistols and hol- sters for Fort Worth Drug Enforcement Administration Task Force '~ officers. ~+ DISCUSSION The Fort Worth Police Department is now, and for a number of years, has par- ticipated~as a major element in the Fort Worth Drug Enforcement Adminis- `` ••t ration-(DEA) Task Force, which includes the D/FW Airport Task Force. This group is composed of local law enforcement agencies combined with the Federal Drug Enforcement Administration. The Task Force is formalized by a written contract that states the conditions of participation by the local agencies and the responsibilities and obliga- tions of the Drug Enforcement Administration. Further, each agency has a representative that sits on the Board of Governors. The Board, as a group, controls the activities and operations that fall outside the limitations of the Task Force contract. ~~~ ~~, There have b:een;some recent changes within the Drug Enforcement Administra- tion. One of"which~'is that the agency is requiring all of its agents to carry a 9mm semiautomatic pistol as their primary service weapon. As a result of this,,~the3agency is requiring all Task Force officers to carry a 9mm semiautomatic pistol as their primary service weapon. Failure to do so will remove that o{fficer and his agency from the umbrella of federal liability. ~ :;'' , ' The Board of .Gover,nors met i n early May, and as a group, agreed that each participati~ngw•agency asupply its officers with a 9mm semi automati c pistol as required by the Drug Enforcement Administration. FINANCING Deposit the $6,900 into General Fund O1, Index Code 055012, Miscellaneous Income, from monies received from restitution payments to the Police Department. ` - - t f e F.; s. . r
