HomeMy WebLinkAboutOrdinance 10238~` ' _ rw y ORDINANCE NO. ~Qa.3 ~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING TWO (2) NORTH/SOUTH ALLEYS AND A PORTION OF OLEANDER STREET ALL LOCATED WITHIN THE LAWN TERRACE ADDITION TO THE CITY OF FORT WORTH, TEXAS, AND ALL BEING MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING FOR REVER- SION OF FEE IN SAID LAND(S); REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the ten (lU) by one hundred thirty (13U) foot long north/ south alley located between Lots 1 through 4 and Lots 13 through 16 OF Block 5; a ten (10) foot by one hundred (l0U) foot long north/ .~ south alley located between Lots 8 and 9, and Lots 10 and 11 of Block 7; and the thirty-five (35) foot by fifty (5U) foot portion of Oleander Street as it runs between Lot 4, Block 4, and Lot 1, Block 8; all located in the Lawn Terrace Addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 63, Page 69, of the Plat Records of Tarrant County, Texas, be and the same are vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land(s) in the above described vacated pub- lic alleys and public street rights-of-way are hereby released and shall revert to the adjacent owner(s) as provided by law SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities and any and all existing and prospective drainage requirements as necessary. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained . DISCUSSION _ Mr Richard Davis, Jr surveyor, representing the Fort Worth Independent School~District, owner of all abutting property, requested the City to vac ate _ the above-described street and alley rights-of-way, as shown on the attached -- map The subject street and alley rights-of-way, acquired by dedication, presently contain sewer, electric and telephone utility facilities. These areas are to be dedicated as a utility easement The subject vacation request is made in order to replat the vacated street and alley rights-of-way with adjacent property, to expand the building area and provide more usable yard space. The required and appropriate monetary consideration, $1.00, has been placed in escrow with. the Real Property Department as required by the Land Agent for the City of Fort Worth. Reviewing City Departments and private utility companies have raised no objec- tion to this request, subject to the vacated rights-of-way being replatted with adjacent property and any required utility easements being retained or relocated at the applicant's expense. A satisfactory replat has been submitted.
