ORDINANCE NO./ ~~/
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING A PORTION OF HART STREET LOCATED IN THE ORIGINAL
TOWN OF HANDLEY ADDITION, AND A PORTION OF LUMBER STREET
LOCATED WITHIN THE ORIGINAL TOWN OF HANDLEY ADDITION AND
THE SPUR ADDITION, BOTH IN THE CITY OF FORT WORTH, TEXAS,
BOTH STREET PORTIONS BEING MORE PARTICULARLY DESCRIBED
HEREIN; PROVIDING FOR A REVERSION OF FEE IN SAID LANDS;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVID-
ING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the fifty (50) foot by five hundred thirty-two (532) foot
portion of Hart Street as it runs from Handley Drive to Lumber
Street and located between Lot 1-R, Block 6 and Lot 1-R, Block 22 of
the Original Town of Handley, the plat of which is recorded in
Volume 8417, Page 2158 of the Plat Records of Tarrant County, Texas,
and the twenty-five (25) foot by two hundred forty-two (242) foot
portion of Lumber Street as it runs two hundred forty two (242) feet
from the north boundry of East Rosedale, located between Lot 1-R,
Block 6, Original Town of Handley, the plat of which is recorded in
Volume 8417, Page 2158 of the Plat Records of Tarrant County, Texas
and Lot 1 of the Spur Addition to the City of Fort Worth, Texas the
plat of which is recorded in Volume 388-48, Page 41 of the Plat
Records of Tarrant County, Texas, be and the same is vacated, aban-
doned and permanently closed and extinguished.
SECTION 2.
That the fee to the lands in the above described vacated public
streets and rights-of-way are hereby released and shall revert to

the adjacent owners as provided by law SAVE AND EXCEPT that ease-
ments are retained for any and all existing and prospective utili-
ties and and all existing and prospective drainage requirements as
necessary.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect from and after the date
of its passage.

It is recommended that City Council adopt an ordinance vacating a 50' X 532'

recommended by the City Plan Commission
DISCUSSION
Mr Barry Hudson, consultant, representing C E.W. Development, owner of all
abutting property, has requested the City vacate the above-described street
rights-of-way, as shown on the attached map.
The subject street and rights-of-way, acquired by dedication, presently contain
water, elctric and gas utility facilities. The subject vacation request is
made in order to replat the vacated street rights-of-way with adjacent
property, to expand the building area and provide more usable yard space.
The required and appropriate monetary consideration, $15,350, has been placed
in escrow with the Real Property Department as required by the Land Agent for
the City of Fort Worth.
Reviewing City Departments and private utility companies have raised no objec-
tion to this request, subject to the vacated rights-of-way being replatted with
adjacent property and any required utility easements being retained or
relocated at the applicant's expense. A satisfactory replat has been
submitted.
