HomeMy WebLinkAboutOrdinance 10441A ~ ORDINANCE N0. /® / AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING A PORTION OF DERIDDER AVENUE LOCATED BETWEEN THE SABINE PLACE N0. 6 ADDITION AND THE LASKO INDUSTRIAL ADDITION, A SIXTY-FOOT WIDE DRAINAGE AND UTILITY EASEMENT, AND A FIVE-FOOT WIDE UTILITY EASE- MENT, BOTH LOCATED WITHIN THE LASKO INDUSTRIAL ADDITION, ALL IN THE CITY QF FORT WORTH, TARRANT COUNTY, TEXAS, AND ALL BEING MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following street right-of-way and easements be and the same are vacated, abandoned and permanently closed and extin- guished: A) A portion of DeRidder Avenue located between Lot 20, Block 35, Sabine Place No. 6 Addition to the City of Fort Worth, Texas, as recorded in Volume 388-70, Page 28 of the Plat Records of Tarrant County, Texas, and Block 1, Lasko Industrial Addition to the City of Fort Worth, Texas, as recorded in Volume 388-157, Page 60 of the Plat Records of Tarrant County, Texas, said portion of street right-of-way being more spe- cifically described in Exhibit "A" which is attached hereto and incorporated herein by reference for all purposes; B) A sixty (60) foot wide drainage and utility easement located in Block 1, Lasko Industrial Addition to the City of Fort Worth, Texas, as recorded in Volume 388-70, Page 28 of the -Plat Records of Tarrant County, Texas, said easement being more specifically described in Exhibit "B" which is attached hereto and incorporated herein by reference for all purposes; and C) A five (5) foot wide utility easement located in Block 1, Lasko Industrial Addition to the City of Fort Worth, Texas, as recorded in Volume 388-70, Page 28 of the Plat Records of Tarrant County, Texas, said ease- ment being more specifically described in Exhibit "C" which is attached hereto and incorporated herein by reference for all purposes. s n ; '' 7 1 i ' . SECTION 2. ~, ,~,. That the fee to the land in the above described vacated pub- lic street right-of-way and easements is hereby released and shall revert to the adjacent owners as provided by law. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. EN L _ QLOCKS 1 & 2 DERIDDER AVENUE, PoLlc~ AD IlwsrRArl~~.x EAST OF WEBBER STREET (V-88-40) F.1tE AOMI ISYR~TION•1 CITY ~JE4 ICES ~ Z RECOMMENDATION• MLANNINO T It is recommended that the City Council adopt an ordinance vacating a 111.9 °` = foot long portion of DeRidder Avenue located between Lot 20, Block 35, Sabine Place #6 Addition, as recorded in Vol. 388-70, Page 28, P.R.T.C.T. and Block 1, Lasko Industrial Addition, as recorded in Vol. 388-157, Page 60, P.R.T.C.T., a 60' wide X approximately 800' long drainage and utility easement and a 5' wide X 60' long utility easement located in Block 1, Lasko Industrial Addition, and recorded in Vol. 6555, Pages 576-580, D.R.T.C.T., as recommended by the City Plan Commission. DISCUSSION Mr. Gordon Swift, Consulting Engineer, representing Lasko Industries, owner of abutting property, has requested that the City vacate the above described street right-of-way, and, utility and drainage easements as shown on the attached reap and further described in the attached field notes designated as Exhibits A,~$$, & C, respectively. The subject street right-of-way, utility, and utility and drainage easements, do not contain any utility facilities. The subject vacation request is being made in order 'to include the vacated rights-of-way and easements as part of the development of the subject property. The Land Agent for the City of Fort Worth has determined that no monetary consideration for the vacation and transfer of the public right-of-way is necessary due to the dedication of additional property to the City of Fort •zWo~rt'h in exchange of this right-of-way. ~,.,.. r. ';Reviewing City departments and private utility companies have raised no objection to this request. A satisfactory replat has been submitted.
