HomeMy WebLinkAboutOrdinance 10244.a .~ a ORDINANCE N0. l©`~ ~ AN ORDINANCE AMENDING ORDINANCE N0. 10215 DEALING WITH THE IMPROVF~4ENT OF SLOCUM AVENUE, BY AMENDING SECTION III THEREOF TO PROVTDE FOR ANEW DATE FOR THE HEARING REQUIRED BY ART. 1105b, R.C.S., AND FOR NOTICE OF SAID HEARING TO BE GIVF~I IN ACCORDANCE WITH SAID STATUTE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I That the third (3rd) paragraph of Section III of Ordinance No. 10215 heretofore adopted by the City Council is hereby amended to read as follows: "Notice shall be given and a hearing shall be held prior to making or levying any assessment against any property abutting the Project or its owners, as required by Article 1105b, Section 9. The notice of the hearing required under said statute shall be published in a newspaper of the City of Fort Worth at least three (3) times, the first publication to be made at least twenty-one (21) days before the hearing date. Written notice shall be personally given to all persons or entities claiming or owning an interest in the property abutting the Project and shall be mailed at least fourteen (14) days before the hearing in the manner specified by Article 1105b, Section 9. Said hearing shall be held before the City Council of Fort Worth, Texas, on the 28th day of February, 1989, at 10:00 A.M." SECTION II. That all other provisions of said Ordinance No. 10215 shall remain in full force and effect. -1- :~ ~. .* SECTION III The City Secretary is directed to engross and enroll this ordinance by copying the caption of same in the minute books of the City Council and by filing the complete ordinance in the ordinance records of the City. IV. This ordinance shall take effect and be in full force and effect from and after the date of its passage. ORIGIN OF PROJECT The 1986-88 Capital Improvement Program, approved in March, 1986, provided funds for the reconstruction of Slocum Avenue from Bonnie Drive to Joyce Drive. This section of Slocum Avenue will extend the recently completed portion of Slocum Avenue from Cherry Lane to Bonnie Drive. On December 8, 1988 (M&C C-11333), the City Council adopted Ordinance No. 10215 awarding the construction contract and establishing January 3, 1989, as the date of the benefit hearing. The notice of the benefit hearing to be held January 3, 1989, was not published in accordance with Article 1105b, V.A.C S. It is therefore recommended that a new benefit hearing date be established and notice of such new hearing date be given in accordance with applicable law.
