AN ORDINANCE SPECIFYING THE AUTHORIZED POSITIONS IN THE
POLICE DEPARTMENT AND ELIMINAT ING TWO OVERAGE POSITIONS
IN THE POLICE DEPARTMENT, PROVIDING THAT THIS ORDINANCE
SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING FOR ENGROSSMENT AND ENROLLMENT OF THIS ORDI-
NANCE; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Police Chief has requested the City Council to
specify and adjust the currently authorized number of positions
in the Police Department for the 1988-89 Fiscal Year, and
WHEREAS, in the City's Appropriation Ordinance 9926, effec-
tive October 1, 1987, for the fiscal year 1987-1988, the autho-
rized and budgeted positions for the Police Department as of
October 1, 1987, were as follows:
Police Officers 611
Corporal/Detectives 168
Sergeants 95
Lieutenants 42
Captains 12
Deputy Chiefs 4
TOTAL 932
WHEREAS, in said Ordinance 9926, budgeting provisions were
also made to increase the manpower for the Police Department to a
total strength of 983 positions at a later tentative date of

April 1, 1988, to be as follows:
Police Officers 651
Corporal/Detectives 172
Sergeants 102
Lieutenants 42
Captains 12
Deputy Chiefs 4
TOTAL 983
WHEREAS, prior to the tentatively scheduled date of April 1,
1988, Ordinance 10063 was adopted February 16, 1988 as the result
of a mid-budget year need to inter alia temporarily adjust the

number of authorized Captains' positions from 12 to 13, to adjust
the number of authorized Sergeant's positions from 102 to 106,
and also to adjust the number of Lieutenants positions from 42 to
43. Said adjustment in the Captains slot was made to reflect the
previously expressed City Council intent to cover the temporary
shortage created when a Police Captain was to be off-work for an
unspecified period of time due to his suffering a heart attack.
The extra Captain's position was created with the intent that it
would be eliminated and the total number of Captain's positions
reduced back to the original 12 authorized positions upon the
said Captain's returning to work or retiring. Four of the said
adjustments in the Sergeant's positions as well as the one
Lieutenant's position were also intended as temporary positions
and were to be phased out as the Department's program for the
civilianization for these same positions was able to be put into
effect. The extra positions were all treated as "overage" posi-
tions in the fiscal budget for that year ( 1987-1988) and thus no
corresponding alteration in the budget was requested or autho-
rized. With the adoption of Ordinance 10063, the authorized
strength for the Police Department as of February 16, 1988, was
as follows:

WHEREAS, after the adoption of Ordinance 10063 and prior to
the end of the fiscal year of 1987-1988, other minor adjustments
(not relevant hereto} were adopted which resulted in no change in
the total authorized strength of the Department; and
WHEREAS, with the passage of Ordinance 10151, on or about
September 27, 1988, the City of Fort Worth's Annual Budget effec-
tive for the new fiscal year of 1988-1989 was authorized, and
therein contained a specific provision again reflecting the tempo-
rary nature of the said Captain's position in the Police
Department's Budget (see p. B-259, attached thereto and ncorpo-
rated therein to said Ordinance 10151); and
WHEREAS, said Captain has now officially retired from the
Police Department effective on or about January 1st, 1989, there-
by eliminating the necessity for the one temporary Captain's posi-
tion which had. been created as set forth above; and
WHEREAS, partial civilianization of the said Sergeant's posi-
tions has since occurred in the Records and Identification
Section, thereby eliminating the necessity for one of the tempo-

rary Sergeant's positions which had been created as set forth
above; and
WHEREAS, the Chief of Police now requests the Council to
bring the authorized number of Police Department Captain and
Sergeant positions into conformity with the actual budgeted posi-
tions authorized by Ordinance 10151 in order to effect efficient
economy of the operations of the City's municipal services;
WHEREAS, the Police Chief desires to eliminate the one tempo-
rary Captain's position and one of the temporary Sergeant's posi-
tion without altering the fiscal budget of the Department; and
WHEREAS, the specification and authorization of the correct
number of budgeted positions is now a necessity; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECT ION 1 .
That effective February 7, 1989, the following positions are
the only positions authorized in the City of Fort Worth Police
Department for the remainder of the fiscal Year 1988-1989:
Police Officers 653
Corporal/Detectives 172
Sergeants 105*
Lieutenants 43
Captains 12**
Deputy Chiefs 4
TOTAL 989
*Eliminates one temporary position with 3 remaining temporary
Sergeant's positons to be phased out upon civilianization of
said positions.
**Eliminates the one temporary Captain's position.

SECT ION 2 .
This Ordinance shall be cumulative of all provisions of
Ordinances and of the Code of the City of Fort Worth, Texas
(1986), as amended, except where the provisions of this Ordinance
are in direct conflict with the provisions of such Ordinances and
such Code, in which event conflicting provisions of such
Ordinances and such Code are hereby repealed.
SECT ION 3 .
The "Mayor and Council Communication" memorandum of
February 7, 1989, reference No. G-7913 is hereby expressly incor-
porated herein by reference for clarification and explanation of
the purposes and intents of the Council in their adoption of this
Ordinance.
SECTION 4.
It is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this Ordinance are severable, and if any phrase,
clause, sentence, paragraph or section of this ordinance shall be
declared unconstitutional by the valid judgment or decree of any
court of competent jurisdiction, such unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences, para-
graphs and sections of this Ordinance, since the same would have
been enacted by the City Council without the incorporation in
this Ordinance of any such unconstitutional phrase, clause, sen-
tence, paragraph or section.

SECT ION 5 .
The City Secretary of the City of Fort Worth is hereby
directed to engross and enroll this ordinance by copying the cap-
tion and effective date in the minutes of the City Council and by
filing the Ordinance in the ordinance records of the City.
SECT ION 6.
This Ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

RECOMMENDATION
It is recommended that the City Council approve the attached ordinance speci-
fying the authorized positions in the Police Department and reducing the
Police Department's authorized strength effective February 7, 1989 by
deleting one captain and one sergeant position. This action is necessary to
achieve consistency with previously expressed Council intent (M&C G-7456,
2/16/88) regarding Police Department civil service staffing.
DISCUSSION
On M&C G-7456, dated February 16, 1988, the civil service positions in the
Police Department were adjusted to add an additional captain position. This
position was added because a captain had suffered a heart attack and was to
be off work for an indefinite period of time. The M&C indicated that when
the captain returned to work or retired, the additional captain position
would be deleted returning the number of authorized captain positions in the
department to twelve. The captain has since returned to work and retired
effective 12-30-88, therefore, the position should now be deleted.
The same M&C referenced above added back four sergeant positions in the
Records and Identification section that had been civilianized in the 1987-88
Adopted Budget. These additional sergeant positions were to be continued
until civilianization occurred. At this time some progress has been made
with civilianization and it is anticipated that four sergeant positions
(three in DECOR and one in the Auto Pound) can be reassigned in the next two
months.
There is currently a sergeant vacancy in the Police Department due to a re-
cent retirement. This vacancy presents an opportunity to absorb one of the
four sergeant positions the Council was requested to establish on a temporary
basis until civilianization efforts made them unnecessary. Civil service
vacancies are required under civil service law to be filled within 60 days
after becoming vacant or be deleted. This position should be deleted now t o
account for one of the four sergeant positions that will need to be absorbed
by the department in the near future. It will be necessary to come back to
the City Council to delete three mare sergeant positions when other vacancies
occur.
These changes will bring the total authorized strength in the Police Depart-
ment to a total of 989 consisting of four e~p~m~t~J~~hij~'fs, 12 Captains, 43
