ORDINANCE NO. /©~~J~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTINGUISHING A 460 FOOT LONG PORT ION OF OLD BENBROOK ROAD LOCATED IN THE B.J. FOSTER SURVEY AND BEING MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING FOR REVERSION OF FEE IN SAID LAND(S); REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. THAT the four hundred sixty foot long portion of Old Benbrook Road, as it runs between West Vickery Boulevard and Mary's Creek Drive in the unplatted L.L. Loop Addition to the City of Fort Worth, Texas in the B. J. Foster Survey, Abstract No. 520, be and the same is vacated, abandoned and permanently closed and extinguished as a public street right-of-way. SECT ION 2. That the fee to the land in the above described vacated public street and right-of-way is hereby released and shall revert to the adjacent owner as provided by law. SECT ION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. a= SECT ION 4 . That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained . Foster Survey (L.L. Loop Addition, unplatted), Abstract No. 520, as recommended by the City Plan Commission.. DISCUSSION Mr. Byron B. Searcy on behalf of Penn Properties, owner of all adjacent property, has requested that the City vacate the above described street right-of-way as shown on the attached map. The subject street right-of -way, acquired by prescription, i s open on the ground, but does not contain any utility facilities. The subject vacation request is being made in order to include the vacated right-of-way as part of this property. The Land Agent for the City of Fort Worth has determined that a value of $4,900 satisfies the interest of the City of Fort Worth in this request. Reviewing City departments and private utility companies have raised no objection to this request. A satisfactory replat has been submitted,.
