V l i.~ .. ~'., ORDINANCE N O ~ D~Q AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS IN THE SPECIAL TRUST FUND, FUND 72, PROJECT 514000-00, RAILTRAN OPERATIONS, OF THE CITY OF FORT WORTH FOR THE FISCAL YEAR 1989 BY THE SUM OF $135,440 AND APPROPRIATING SAID $135,440 TO THE SPECIAL TRUST FUND, FUND 72, PROJECT 514000-00, RAILTRAN OPERATIONS, FOR UNANTICIPATED COSTS ASSOCIATED WITH THE DEVELOPMENT OF THE RAILTRAN INFORMATION MANAGEMENT PROGRAM, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1989 and in the Budget of the City Manager, there shall also be increased estimated receipts in the Special Trust Fund, Pund 72, Project No 514000-00, RAILTRAN Operations, by the sum of $135,440 and appropriating said $135,440 to the Special Trust Fund, Fund 72, Project No 514000-00, RAILTRAN Operations, for unanticipated costs associated with the development of the RAILTRAN Information Management Program SECTION 2 Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect SECTION 3 That this ordinance shall be cumulative of Ordinance No 10151 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and effective date into the minutes of the City Council and by filing this ordinance in the ordinance records of the City of Fort Worth. Accept the transfer of $135,440 from the Dallas RAILTRAN operating accounts for deposit to Special Trust Fund 72, Project No. 514000-00, RAILTRAN Operations, and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in Special Trust Fund 72, Project No. 514000-00, RAILTRAN Operations from increased revenue, and 3. Authorize the City Manager to approve an increase in the amount of the contract with Ned K. Burleson & Associates by $135,440 for a total of $748,840, and 4. Authorize the City Manager to expend $135,440 from available appropriations in Special Trust Fund 72, Project No. 514000-00, RAILTRA N Operations. BACKGROUND On August 25, 1987 the City Council approved the RAILTRAN Information Management Program. This program consisted of three parts 1. inventory of property, 2. centerline survey including setting of monuments and horizontal and vertical controls, and 3. aerial survey and mapping. Information obtained from the above work program is being compiled into a computerized RAILTRAN data base which will assist the RAILTRAN Policy Committee,.. and. staff in making informed policy decisions and provide a base for the pl~a~n'ni`ng study. Unforeseen problems i nvol vi ng rai 1 road operations , mai nten~ance -d'ee'ds and maps have increased the complexity of property ~,~ boundary analysis and data input and increased the costs accordingly. The RAiLTRAN,Policy Committee has reviewed the request and their recommendation is to approve the payment of an additional $135,440 to Ned K. Burleson & Associates.
