HomeMy WebLinkAboutOrdinance 10261~- .~ < ? ~.~ ~~ ORDINANCE NO . ~~ ~ b AN ORDINANCE ESTABLISHING THE BOUNDARIES OF THAT POR- TION OF FOREST PARK KNOWN AS THE FORT WORTH ZOOLOGICAL PARK; REPEALING CONFLICTING ORDINANCES; MAKING THIS ORDINANCE CUMULATIVE OF OTHER ORDINANCES; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. ., ~ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS o SECT ION 1 . That the boundaries of that portion of Forest Park known as the Fort Worth Zoological Park shall be established as shown in the field notes marked Exhibit "A", attached hereto and incorpo- rated herein, and as shown on that map marked Exhibit "B" which is on file in the office of the City Secretary and is likewise incorporated herein. SECTION 2 . This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provision of such ordinances and such Code, in which event conflicting provisions of such ordi- nances and such Code are hereby repealed. SECTION 3 . It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any ~h r is court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, para- graphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sen- tence, paragraph or section. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the cap- tion and Section 1 in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECTION 5 . This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. Discussion One condition of the City Council's approval of the Forest Park Master Plan on October 6, 1987 (M&C G-7285) was that a detailed study be prepared that defines the boundaries of the Zoo within the Park. The boundary survey of the Zoo, prepared by the Transportation/Public Works Department with assistance from the Park and Recreation Department, reflects the presently fenced Zoo area (42.7 acres) and its proposed expansion to the west and north. The proposed Zoo expansion area would encompass a portion of the University Drive parking lot, the amusement rides area, and a portion of the athletic fields area off Colonial Parkway. The Zoo Master Plan programs a maintenance complex, African Rain Forest and African Savannah in the expansion area. While one of the two existing athletic fields will beoccupied by future exhibit space, the remaining field will have to be re-aligned in the remaining ..open space. The remaining open space would facilitate a relocated field with the existing dimensions of 200' x 360'. The proposed Zoo boundary reflects the Forest Park Master Plan layout and comments made at numerous Park and Recreation Advisory Board meetings. The result of this boundary would es tabl ish a current Zoo boundary of 58.532 acres.
