"' ~` ~• ORDINANCE N O ~~ AN ORDINANCE INCREASING THE APPROPRIATIONS IN THE GENERAL FUND 01 OF THE CITY OF FORT WORTH FOR THE FISCAL YEAR 1989-90 BY $50,174 21 BY APPROPRIATING SAID AMOUNT FROM THE UNRESERVED, UNDESIGNATED FUND BALANCE OF THE GENERAL FUND 01, AND APPROPRIATING THE SAID $50,174.21 TO THE GENERAL FUND 01, NON-DEPARTMENTAL ACCOUNT 90-55-00, CONSULTANT FEES, FOR THE PURPOSE OF COMPENSATING CONSULTANTS FOR WORK RELATED TO THE RETIRED CITY EMPLOYEES' HEALTH INSURANCE AND RELATED ISSUES, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, PROVIDING FOR ENGROSSMENT AND ENROLLMENT, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY ~OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1989-90 and in the Budget of the City Manager, there shall also be increased appropriations in the General Fund 01 of the City of Fort Worth in the amount of $50,174.21 by appropriating said amount from the Unreserved, Undesignated Fund Balance of the General Fund 01, and appropriating said $50;174.21 to the General Fund 01, Non-Departmental Account 90-55-00, Consultant Fees, for the purpose of compensating consultants for work related to the retired City Employees' Health Insruance and related issues. LAWSON OF THE FIRM OF , of_1 12-12-89 **G-8353 RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached supplemental appropriation ordinance increasing appropriations in the General Fund O1 by $50,174.21 by appropriating said amount from the Unreserved, Undesignated Fund Balance of the General Fund and appropriating said $50,174.21 to the General Fund O1, Non-Departmental Account No. 90-55-00, Consultant Fees, for the purpose of compensating consultants for work related to the retired City employees' health insurance and other related issues; 2. Adopt the attached Resolution increasing to $60,174.21 to the maximum total compensation to be paid to Gary B. Lawson of the firm of Godwin, Carlton and Maxwell for his legal services in the matters regarding responsibility for retired City employees' health insurance and related issues; and 3. Authorize the payment of $35,174.21 to Mr. Lawson for his legal services rendered in October and November of 1989. DISCUSSION: By M&C G-8212, dated September 19, 1989, the City Council retained Mr. Gary B. Lawson as outside counsel to consult with the City Council and represent the City in matters regarding responsibility for retired City employees' health insurance and related issues. The City has received a statement from Mr. Lawson in the amount of $35,174.21 for legal services rendered during the months of October and Nove+nber of 1989. Upon receipt of the statement, the City Attorney reviewed the charges, found them to be reasonable and recommends payment. In order to provide funding to pay the additional a+nount required for these legal services, it will be necessary for the Council to adopt a supplemental appropriation ordinance. FINANCING: Upon adoption of the attached Supplement Appropriation Ordinance, sufficient funds will be available in General Fund O1, Non-Departmental, Account No. 90-55-00, Consultant Fees. Expenditures will be charged to Index Code 328005. The General Fund O1 Unreserved, Undesignated fund balance is est~~~1~c~Qt$~Ybe $240,532.66 after this transfer.
