AN ORDINANCE AMENDING CHAPTER 22 (ARTICLE VI) OF
THE CODE OF THE CITY OF FORT WORTH ( 1 986) , AS
AMENDED, MAKING CERTAIN ACT IONS RELATED TO THE
PARKING, STOPPING OR STANDING OF VEHICLES CIVIL
OFFENSES SUBJECT TO CIVIL FINES AND PENALTIES

A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT
AN D ENROLLMENT; PROVIDING FOR PUBLICATION AS
REQUIRED BY LAW; PROVIDING A PENALTY CLAUSE; AN D
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH
SECTION I .
That Article VI (Stopping, Standing and Parking) of
Chapter 22 of the Code of the City of Fort Worth (1986), as
amended, is hereby amended by adding thereto a new Section
22-178 as set forth in Exhibit "A", attached hereto and
incorporated herein, and the violation of the provisions of
said section shall be civil offenses subject to civil
penalties and fines pursuant to the procedures for administra-
tive adjudication as set forth in Chapter 10 of the Code.
SECT ION I I .
This ordinance shall be cumulative of all provisions
of ordinances and of the Code of the City of Fort Worth,
Texas (1986), as amended, except where the provisions of this
ordinance are in direct conflict with the provisions of such
ordinances and such Code, in which event conflicting provi-
sions of such ordinances and such Code are hereby repealed.

SECTION I I I .
It is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and if any phrase,
clause, sentence, paragraph or section of this ordinance
shall be declared unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such unconsti-
tutionality shall not affect any of the remaining phrases,
clauses, sentences, paragraphs and sections of this ordi-
n ance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any
such unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION IV.
The City Secretary of the City of Fort Worth is hereby
directed to engross and enroll this ordinance by copying the
caption and Sections I, VI and VII in the minutes of the City
Council and by filing the ordinance in the ordinance records
of the City.
SECTION V.
The City Secretary of the City of Fort Worth, Texas, is
hereby directed to publish the caption and Section VI of this
ordinance for two (2) days in the official newspaper of the
City of Fort Worth, Texas, as authorized by Section 52.013,
Texas Local Government Code.

SECT ION VI .
Any person, firm or corporation who violates, disobeys,
omits, neglects or refuses to comply with or who resists the
enforcement of any of the provisions of this ordinance shall
be fined not more than Two Hundred Dollars ($200.00) for each
offense.
SECT ION VII .
This ordinance shall be in full force and effect from
and after its passage and publication as required by law, and
it is so ordained.

EXHIBIT "A"
Sec. 22-178. Stopping, standing and parking prohibited in
certain places.
(a) Except when necessary to avoid conflict with other
traffic, or in compliance with law or the directions of a
police officer or official traffic-control device, no person
shall:
(1) Stop, stand or park a vehicle:
(A) at any place where official signs prohibit
stopping;
(B) on the roadway side of any vehicle stopped or
parked at the edge or curb of a street;
(C) on a sidewalk;
(D) within an intersection;
(E) on a crosswalk;
(Fj between a safety zone and the adjacent curb or with-
in thirty (30) feet of points on the curb immedi-
ately opposite the ends of a safety zone, unless a
different length is indicated by signs or markings;
(G) alongside or opposite any street excavation or
obstruction when stopping, standing or parking
would obstruct traffic;
(H) upon a bridge or other elevated structure upon a
highway or within a highway tunnel; or
(I) on any railroad track.
(2) Stand or park a vehicle, whether occupied or not, except
momentarily to pick up or discharge a passenger or passen-
gers
(A) at any place where official signs prohibit stand-
ing ;
(B) in front of a public or private driveway;
(C) within fifteen (15) feet of a fire hydrant;
(D) within twenty (20) feet of a crosswalk at an inter-
section;

(E) within thirty (30) feet upon the approach to any
flashing signal, stop sign, yield sign, or traffic-
control signal located at the side of a roadway; or
(F) within twenty (20) feet of the driveway entrance to
any fire station and on the side of a street oppo-
site the entrance to any fire station within
seventy-five (75) feet of said entrance (when
properly sign-posted).
(3) Park a vehicle, whether occupied or not, except tempo-
rarily for the purpose of and while actually engaged in load-
ing or unloading merchandise or passengers:
(A) at any place where official signs prohibit parking,
or
(B) within fifty (50) feet of the nearest rail of a
railroad crossing.
(b) Except where official signs or markings indicate
otherwise, every vehicle stopped or parked upon a two-way
roadway shall be so stopped or parked with the right-hand
wheels parallel to and within eighteen (18) inches of the
right-hand curb or edge of the roadway.
(c) Except where official signs or markings indicate
otherwise, every vehicle stopped or parked upon a one-way
roadway shall be so stopped or parked parallel to the curb or
edge of the roadway, in the direction of authorized traffic
movement, with its right-hand wheels within eighteen (18)
inches of the right-hand curb or edge of roadway, or its
left-hand wheels within eighteen (18) inches of the left-hand
curb or edge of roadway.
(d) All words and .phrases used in this section shall
have the same meaning as they are defined in the Uniform Act
Regulating Traffic on Highways, Tex. Rev. Civ. Stat. Ann.
Art. 6701d.

RECOMMENDATION
It i~s recommended that the City Council adopt the attached ordinance
amen8ing Chapter 22 (Article VI), City Code, by adding Section 22-178
thereto which codifies certain stopping, standing and parking offenses.
DISCl3SSI0N
On May 3, 1988, City Council adopted Ordinance No. 10107 which
implemented a civil adjudication process for parking violations. The
ordinance was effective September 1, 1988.
On-going analysis of the provisions of the City Code related to parking
offenses has indicated the desirability of codifying all City parking
violations in Article VI of Chapter 22. This will facilitate the
finding of applicable law and will clarify the original jurisdiction of
the Parking Violation Bureau over such offense.
