QJ AN ORDINANCE AMEN DING ORDINANCE NOS. 2999, 4060, 4250, 4304, 9354, 4430, 4860, 4861, 4873, 4875, 5226, 5259, 6393, 6556, 7056, 7317, 7875, 8674, 8843, 9247, 9532, 10081 AND 10291, CODIFIED AS CHAPTER 2, ARTICLE VI, DIVISION 1, ENTITLED "EMPLOYEES' RETIREMENT FUND", OF THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED, WHICH ORDINANCES ESTABLISH AND PROVIDE FOR A RETIREMENT SYSTEM, RETIREMENT PLAN AND BENEFITS THEREUNDER FOR EMPLOYEES OF THE CITY OF FORT WORTH; ALLOWING FOR REFUND OF MEMBER CONTRIBUTIONS WITH REGULAR INTEREST AFTER RETIREMENT; MAKING THIS ORDINANCE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSS- MENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS; That Ordinance No . 2999, passed and adopted by the City Council of the City of Fort Worth on the 24th day of September, A.D. 1952, as amended by Ordinance Nos. 4060, 4250, 4304, 4354, 4430, 4860, 4861, 4873, 4875, 5226, 5259, 6393,, 6556, 7056, 7317, 7875, 8674, 8843, 9247, 9532, 10081 and 10291, be and the same is hereby further amended as follows SECTION I. That Chapter 2, Article VI, Division I, Section 2-212, "Termination Benefits and Vesting" of the Code of the City of Fort Worth ( 1986), as amended, be and is hereby further amended by adding Subsection (e), and after such addition, Subsection (e) shall read as follows, to wit: "(e) A vested member who has commenced to draw retire- ment income may elect to receive a refund of his contribu- tions, plus regular interest, in lieu of any further retirement benefits, but by so doing he shall release and forfeit. all rights under the Fund and thereafter be entitled to no further benefits under this article." 4 a _ 1T ~f SECTION II. CONTROLLING POWER OF ORDINANCE The provisions of this ordinance shall be cumulative of and in addition to all other ordinances of the City of Fort Worth relating to pensions, which ordinances are hereby preserved and continued in force and effect; provided, however, that, in the event of any conflict, the provisions of this ordinance shall control . SECT ION I I I . VALIDITY OF ORDINANCE If any provision, section, part, subsection, sentence, clause, phrase or paragraph of this ordinance be declared invalid or unconstitutional, the same shall not affect any other portion or provision hereof, and all other provisions shall remain valid and unaffected by an y invalid portion, if any, and the City Council now says that, if it had known at the time of the passage of this ordinance that any portion of said ordinance was invalid, it would not have adopted such invalid part. SECTION IV. PREREQUISITES TO ORDINANCE The City Council finds that all acts, conditions and things required by provisions of the Constitution of Texas and the Charter and Ordinances of the City of Fort Worth precedent to and in the adoption of this ordinance have been done, have happened and have been performed in proper and lawful time and manner. -2- ~'~, '' , . f .. ~. .~ ~ • ~_ SECTION V. ENGROSSMENT AND ENROLLMENT The City Secretary of the City of Fort Worth is hereby directed to engross and enroll thist ordinance by copying the caption and effective date of same in the minutes of the City Council of the City of Fort Worth and by filing this ordinance in the ordinance records of said City. SECT ION VI . EFFECTIVE DATE This ordinance shall be in full force and effect from and after the date of its adoption and it is so ordained. It is recommended that the City Council adopt the attached amendment to the City Retirement Ordinance, Section II which amends the Ordinance to provide for payment by the Retirement Fund of the costs of retirees' health insurance and Section I which amends the Ordinance to provide for post-retirement, lump-sum withdrawal of contributions. DISCUSSION Beginning with the 1984-85 budget year and continuing through 1988-89, the Retirement Fund Board of Trustees annually approved payment to the City from the Retirement Fund of the costs of retirees' health insurance. In November 1988, the Board of Trustees informed the City Manager of their intention to discontinue this payment for all future years. Subsequent to this action the City Council was advised that without funding from the Retirement Fund the projected $3.2 million costs for 1989-90 would have to be assumed by the City budget. In response, the City Council contracted with A. Foster Higgins and Company, Inc. to provide professional assistance in identifying and evalu- ating their short-term options as well as long-term strategy for addressing the issue of post-retirement medical benefits. Among other recommendations in the Foster Higgins report to the Council was the recommendation to amend the Retirement Ordinance to specifically provide for the past voluntary payments for health insurance by the Retirement Fund and to provide for the 1989-90 payment by Council authorization. The attached amendment to the Ordinance will accomplish this recommendation. Also included in the attached amendment is a no-cost amendment which will allow a retiree, currently receiving benefits, to receive the balance of any remaining employee contribution in lump-sum and release the Retirement Fund from any obligation for future benefits.
