ORDINANCE N0.
AN ORDINANCE AMENDING SECTIONS 35-56(a), 35-56(b),
35-56(c) AND 35-56(d) AND ADDING SECTIONS 35-56(f) AND
35-56(g) OF CHAPTER 35 OF THE CODE OF THE CITY OF FORT
WORTH (1986), AS AMENDED, BY ADDING A DEFINITION AND
REVISING CERTAIN RATES AND CHARGES; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE
IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR
ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH:
SECTION 1.
That Section 35-56(a) of Chapter 35 of the Code of the
City of Fort Worth ( 1986) , as amended, and be the same is hereby
amended by adding the following definition:
"A wholesale customer is a municipality, town, village or
other governmental entity or private firm contracting with a
governmental entity for the provision of water andlor wastewater
service."
SECTION 2.
That Section 35-56(b) of Chapter 35 of the Code of the
City of Fort Worth ( 1986) , as amended, be and the same is hereby
amended and, after having been amended, shall be read as follows:

"(b) The following schedule of rates per month, or fraction
thereof, shall be the charges to all residential and nonresi-
dential customers for furnishing water to such customer located
within the city. The residential monthly volume charge for water
service shall be the charges to the residential customer class,
as defined in this chapter, for furnishing water to residential
water customers located within the city The nonresidential
monthly volume charge for water service shall be the charges to
the nonresidential customer class, as defined in this chapter,
for furnishing water to nonresidential water customers located
within the city."

The service charges set out in the foregoing schedule are based
upon the amount of water used as measured by meters.

SECTION 3.
That Section 35-56(c) of Chapter 35 of the Code of the
City of Fort Worth (1986) , as amended, be and the same is hereby
amended and, after having been amended, shall be and read as
follows:
"(c) The following schedule of rates per month or fraction
thereof shall be the basis for determining charges to all
customers for rendering sanitary sewerage service, where the
sewage produced by such customer is a normal strength wastewater
(two hundred ten (210) mg/1 B.O.D. and two hundred forty (240)
mg/1 suspended solids} and where such customer is located within
the city:
RATES FOR SEWERAGE SERVICE ONLY
(1) A monthly service charge shall be charged to all
customers in the amount of four dollars and fifty cents
($4.50}.
(2) A monthly volume charge shall also be charged to all
customers in the amount of eight hundred and seventy-
one thousandths of a dollar ($0 871) per one hundred
(100) cubic feet of water used, or waste water
produced, as more specifically set forth hereinafter."
"The monthly volume charges for residential class
customers will be based on the individual customer's average

monthly water use during the preceding winter quarter months of
December, January and February. The volumes used to compute
these charges are based on the amount of water used by the
residential class customer as measured by a meter. Where no
preceding winter quarter average is available from records, the
director shall estimate a volume to be used for this monthly
volume charge."
"The monthly charges to commercial and industrial class
customers will be based on total water use as measured by
appropriate meters, with the provision that if a customer can
show, to the satisfaction of the director of the water depart-
ment, that a significant portion of the metered water usage does
not enter the sanitary sewers, the customer will be charged for
only that volume entering the sewers, as determined by a method
approved by the director."
SECTION 4.
That Section 35-56(d} of Chapter 35 of the Code of the
City of Fort Worth (1986 } , as amended, be and the same is hereby
amended and, after having been amended, shall be and read as
follows:
"(d) The director of the water department shall establish a
monitored group class, consisting of those customers whose waste-

water strength is, in his judgment, abnormally high or whose
wastewater contains limited substances or materials, and charges
to customers in this class shall be computed in accord with the
following five-part rate schedule:
MONITORED GROUP

B.O.D. strength charge, per pound of B.O.D. $0.074

Monitoring and pretreatment charge Total actual

"The monitoring charge shall consist of all cost for
personnel, material and equipment used to collect and analyze
samples from the customer wastewater to determine the strength
of the wastewater produced and, when appropriate, to inspect
pretreatment facilities, to administer pretreatment permit
systems and to enforce ordinance requirements Pretreatment
requirements primarily affect industries which discharge toxic
substances into the sewerage system."
"This schedule shall replace all other charges previously
made for industrial waste strength "
SECTION 5.
That Section 35-56(f) of Chapter 35 of the Code of the
City of Fort Worth (1986) , as amended, be and the same is hereby

amended and, after having been amended, shall be and read as
follows:
"(f) The following schedule of rates per month, or fraction
thereof, shall be the charges to all wholesale customers for
furnishing water to such customers.

SECTION 6.
That Section 35-56 of Chapter 35 of the Code of the
City of Fort Worth (1986), as amended, is hereby further amended
by adding subsection 35-56 (g), and after having been added,
subsection 35-56 (g) shall be and read as follows:
"(g) The following schedule of rates per month, or fraction
thereof, shall be the charges of all wholesale customers for
furnishing wastewater service to such customers.

SECTION 7.
That Section 35-56 of Chapter 35 of the Code of the
City of Fort Worth (1986), as amended, is hereby further amended
by adding subsection 35-56 (h), and after having been added,
subsection 35-56 (h) shall be and read as follows:
"(h) Charges paid by municipal departments for water and
sewerage services shall be paid for at the rates in effect "
SECTION 8.
This ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth, Texas
(1986), as amended, except where the provisions of this ordinance
are in direct conflict with the provisions of such ordinances and
such Code, in which event conflicting provisions of such
ordinances and such Code are hereby repealed.
SECTION 9.
It is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and if any phrase,
clause, sentence, paragraph or section of this ordinance shall be
declared unconstitutional by the valid judgment or decree of any
court of competent jurisdiction, such unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would

have been enacted by the City Council without the incorporation
in this ordinance of any such unconstitutional phrase, clause,
sentence, paragraph or section.
SECTION 10.
The City Secretary of the City of Fort Worth is hereby
directed to engross and enroll this ordinance by copying the
caption in the minutes of the City Council and by filing the
ordinance in the ordinance records of the City.
SECTION 11
That this ordinance shall become effective and be in
full force and effect from and after its passage; provided,
however, that the increased rates specified herein shall apply to
residential, nonresidential, and wholesale utility statements
sent by the City of Fort Worth on or after November 1, 1989, and
it is so ordained.

RECOMMENDATION
It is recommended that the City Council approve the attached ordinance which
revises water and sewer rates with an effective date of billing on or after
November 1, 1989, and approve a net combined water and sewer rate increase of
13.9% above existing volume charges rates.
DISCUSSION
Since the water and sewer rate increase last year, debt service, raw water
costs, and other operation and maintenance costs have continued to increase.
Two major water expenditures, raw water costs and debt service, are expected
to increase by $1,053,595 (4.5%) and $4,475,870 (40.3%) respectively. Due to
major sewer capital improvements by the Trinity River Authority and the City,
sewer debt service is expected to increase by $2,855,327 (24.7%).
Without a rate increase to offset the increased costs in the FY 89/90 budget,
the projected combined deficit for this year is $10,924,072. The large
on-going water and sewer CIP program is expected to continue to drive up debt
service and operation and maintenance costs in the coming years. The pro-
posed 1990 water and sewer budget reflects every effort to restrain costs,
including delaying the issuance of bonds through the use of a commercial
paper program to fund for the construction of the Eagle Mountain Lake Water
Treatment Plant and related projects until 1990, and obtaining low interest
State revolving fund loans for Village Creek Wastewater Treatment Plant expan-
sion projects. Water and sewer operating fund reserves are not adequate to
offset the need for FY 1990 water and sewer rate increases.

The Water Department staff conducted a water cost of serv~i~ce study and pre-
sented water and sewer rate increase recommendations to the Council Rate
Committee on July 11, 1989. As a result of these discussions with the Rate
committee, water and sewer rate increases of 10.2% and 20.8, respectively,
based on volume, are recommended. These percentages represent the net aver-
age. Percentage change of each individual component of the water and sewer
charge varies slightly.

RATE INCREASES AND RATE -~f-
Wholesale Rates
In accordance with provisions of the Customer Contracts for wholesale water
and wastewater service, consulting firms are engaged every three years to
review rate methodology and update wholesale water and wastewater rates.
Rates will be revised in interim years by the Fort Worth Water Department
staff .
For FY 1990 rates, the water rate study was performed by Touche Ross and
Company. The wastewater rate study was completed by Peat Marwick Main and
Company. The studies resulted in the following rate structures

The cost of untreated water supplied by Tarrant County Water Control and
Improvement District No. 1 is $0.49007 for use inside the District and
$0.58007 outside th.e District. Adjusted for street rental and system loss,
