AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTINGUISHING ALL PUBLIC STREET RIGHTS-OF-WAY AND UTILITY EASEMENTS LOCATED IN BLOCKS 5 AND 6, SCENIC VILLAGE ADDITION; PROVIDING FOR REVERSION OF FEE IN SAID LANDS ; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH AND PROVIDING AND EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH , TEXAS SECT ION 1 . THAT all street rights-of-way and utility easements located in Blocks 5 and 6, Scenic Village Addition to the City of Fort Worth, as recorded in Volume 388-G, Page 45, Plat Records, Tarrant County, Texas be and the same are vacated, abandoned, and permanently closed and extinguished. SECTION 2 . That the fee to the lands in the above described vacated public streets rights-of-way and utility easements are hereby released and shall revert to the adjacent owner as provided by law. SECTION 3 . T hat all or dinances or parts of ordinances in conflict here- with are hereby repealed. SECT ION 4 . PAGE b R 21 1!989 , NUMBER ND UTILITY EASEMENTS, SCENIC 1 . **PZ-1543 VILLAGE ADDITION, Blocks 5 & 6 >°f-_ ue onne rive Genic our (V-87-55) RECOMMENDATION It is recommended that the City Council adopt an ordinance vacating all street rights-of-way and utility easements located in Blocks 5 and h, Scenic Village Addition, as recorded in Volume 388-G, Page 45, P.R.T.C.T., as recommended by the City P1 an Commission DISCUSSION Ms. Robin Yakl in, owner of the subject property, has requested that the City vacate the above described street rights-of-way and utility easements as shown an the attached map. The subject street rights-of-way, .acquired by dedication, are partially open on the ground but in deteriorated condition. The subject street rights-of-way and utility easements do not contain any utility facilities. The subject vacation request is being made in order to include the vacation rights-of-way and utility easements as part of the redevelopment of the subject property. The owner is dedicating and conveying other property to the City in exchange for they vacated rights-of-way, and the Director of Real Property Management has determined that the exchanged land constitutes fair market value as requ i rE~d by 1 aw. Reviewing City departments and private utility companies have raised no objection to this request. A satisfactory replat has been submitted.
