ORDINANCE NO. a
AN ORDINANCE AMENDING SECTION XIII OF CITY OF FORT
WORTH ORDINANCE N0. 10271, BY PROVIDING THAT IN THE
EVENT OF A TIE OR IN THE EVENT THAT NO CANDIDATE RE-
CEIVES A MAJORITY OF ALL VOTE5 CAST FOR THE OFFICE
SOUGHT AT THE MAY 6, 1989, CITY COUNCIL ELECTIONS, THE
MAYOR, ON THE FIRST DAY AFTER COMPLETION OF THE
OFFICIAL TABULATION AND CANVASS OF THE RETURNS, SHALL
ISSUE A CALL, PROCLAMATION AND NOTICE FOR A SECOND ELEC-
TION, AS REQUIRED BY LAW, TO BE HELD ON MAY 20, 1989,
TO FILL THAT PLACE, AT WHICH SECOND ELECTION THE TWO
CANDIDATES RECEIVING THE HIGHEST NUMBER OF VOTES FOR
ANY SUCH OFFICE OR OFFICES, AS THE CASE MAY BE, IN THE
FIRST ELECTION, AT WHICH NO ONE WAS ELECTED BY RECEIV-
ING A MAJORITY OF ALL VOTES CAST FOR ALL CANDIDATES FOR
SUCH OFFICE OR OFFICES, SHALL AGAIN BE VOTED FOR;
MAKING THIS ORDINANCE CUMULATIVE OF ALL ORDINANCES;
REPEALING ALL ORDINANCES AND PROVISIONS IN CONFLICT
HEREWITH; PROVIDING A SEVERABILIT Y CLAUSE; AN D PROVID-
ING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1 .
That Section XIII of Ordinance No. 10271 be and the same is
hereby amended, and following said amendment Section XIII of
Ordinance No. 10271 shall read and be as follows:
"SECTION XIII.
"That any candidate receiving a majority of all the
votes cast for the office for which he is a candidate
shall be elected to such office; but that, in the event
of a tie or in the event that no candidate receives a
majority of all the votes cast for the office sought,
the Mayor, on the first day after the completion of the
official tabulation and canvass of the returns, shall
issue a call, proclamation and notice for a second elec-
tion, as required by law, to be held on May 20, 1989,
to fill that place, at which second election the two
candidates receiving the highest number of votes for
any such office or offices, as the case may be, in the
first election, at which no one was elected by receiv-
ing a majority of all the votes cast for all candidates
for such office or offices, shall again be voted for."

SECTION 2.
This ordinance shall be, and is hereby, declared to be cumu-
lative of all other ordinances of the City of Fort Worth, andr
this ordinance shall not operate to repeal or affect any of such
other ordinances except insofar as the provisions thereof might
be inconsistent or in conflict with the provisions of this ordi-
nance, in which event such conflicting provisions, if any, in any
such prior ordinance or ordinances are hereby repealed.
SECT ION 3
If any section, subsection, sentence, clause or phrase of
this ordinance is for any reason held to be unconstitutional,
such holding shall not affect the validity of the remaining por-
tions of this ordinance, and all of the remainder of this ordi-
nance not so held to be unconstitutional shall continue to be in
full force and effect.
SECTION 4 .
That it is hereby officially found and determined that the
meeting at which this ordinance was adopted was open to the pub-
lic and public notice of the time, place and purpose of said
meeting was given, all as required by Vernon's Annotated Civil
Statutes, Article 6252-17, as amended.

SECTION 5 .
This ordinance shall take effect and be in full force and
effect from and after the date of its passage.
