HomeMy WebLinkAboutOrdinance 10288~. , y `'~ ~ ~ ~„k ORDINANCE NO. ~~_ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING A PORTION OF LOVELL AVENUE AND A PORTION OF MONTGOMERY STREETS BOTH LOCATED WITHIN THE BROOKLYN HEIGHTS ADDITION TO THE CITY OF FORT WORTH AND BOTH BEING MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING A REVERSION OF FEE IN SAID VACATED PORTIONS OF STREETS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PRO- VIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 . THAT the portion of Lovell Avenue and the portion of Montgomery Street, both more specifically described in Exhibit "A" which is attached hereto and incorporated herein by reference for all purposes, and both being located within the Brooklyn Heights Addition to the City of Fort Worth, the plat of which is recorded in Volume 63, Page 13, of the Plat Records of T arrant County, Texas, be and the same are vacated, abandoned and permanently closed and extinguished. SECTION 2 . That the fee to the above described vacated portions of pub- lic streets and rights-of-way is hereby released and shall revert to the adjacent owner(s) as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities and any and all existing and prospective drainage re- quirements as necessary. SECTION 3 . That all ordinances or parts of ordinances in conflict here- with are hereby repealed. ~: ,~ ~: ., SECT ION 4 . Should the City Council find that conditions have changed substantially, since the Plan Commission's denial of the subject proposal on October 26, 1988, it is recommended that the appeal, as requested by the applicant's engineer, Gordon S. Swift, be granted and that the Council adopt the attached ordinance vacating a portion of Lovell Street and Montgomery Street. DISCUSSION: Mr. Gordon Swift, consulting engineer representing the owner of a parcel of commercial land on the northwest corner of Lovell Avenue at Montgomery Street, requested the vacation of a portion of Lovell Street and Montgomery Street to be used as part of the commercial business property (a plant nursery). Following a public hearing before the City Plan Commission on October 26, 1988, during which opposition by a nearby property owner was voiced, this request was denied. All requirements outlined in the Staff Information Report, as presented to the City Plan Commission on October 26, 1988 (see attached copies of Staff Information Report and minutes of the Plan Commission hearing) have been met and a satisfactory replat has been provided.
