ORDINANCE NO. ~3
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING A FIFTEEN ( 15) FOOT BY TWO HUNDRED NINETY
(290) FOOT ALLEY, AND A FIFTEEN (15) FOOT BY ONE
HUNDRED FORTY ( 140 ) FOOT ALLEY, BOTH LOCATED WITHIN THE
INTERURBAN ADDITION TO THE CITY OF FORT WORTH, TEXAS
AND BOTH BEING MORE SPECIFICALLY DESCRIBED HEREIN;
PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECT ION 1 .
THAT the fifteen (15) foot by two hundred ninety (290) foot,
east/west alley located between Lots 10 through 15 and Lots 16
through 21 , Block 22, and the f fifteen ( 15 ) by one hundred forty
(140) foot east/west alley located between Lots 1 through 3 and
Lots 18 through 20 of Block 7, both within the Interurban
Addition to the City of Fort Worth, the plat of which is recorded
in Volume 106, Page 157 of the Plat Records of Tarrant County,
Texas, be and the same is vacated, abandoned and permanently
closed and extinguished.
SECT ION 2 .
That the fee to the lands in the above described vacated
public alleys and rights-of-way are hereby released and shall
revert to the adjacent owner as provided by law, SAVE AND EXCEPT
that easements are retained for any and all existing and prospec-
tive utilities and an y and all existing and prospective drainage
requirements as necessary.
SECTION 3 .
That all ordinances or parts of ordinances in conflict here-
with are hereby repealed.
SECTION 4 .
That this ordinance shall take effect and be in full force
and effect from and after the date of its passage, and it is so
ordained .

RECOMMENDATION
It is recommended that the City Council adopt an ordinance vacating a 15' X
290' long east/west alley located between Lots 10 thru 15 and 16 thru 21,
Block 22, and a 15' X 140' long east/west alley located between Lots 1, 2,
3, and 18 thru 20, Block 7, of Interurban Addition, as recorded in Volume
106, Page 157, P.R.T.C.T.
DISCUSSION
Captain Marshall Gesner, with the Salvation Army, owner of all abutting
property, has requested that the City vacate the above described alley
rights-of-way, as shown on the attached map.
The subject alley rights-of-way, acquired by dedication, presently contain
electric, telephone, and sewer utility facilities. This area is to be used
for construction of a new facility and satisfactory arrangements have been
made with the utility providers to relocate the subject utilities within
dedicated easements.
The required and appropriate monetary consideration, $500.00, has been
placed in escrow with the Real Property Department as required by the Land
Agent for the City of Fort Worth.
Reviewing City departments and private utility companies have raised no
objection to this request, subject to the vacated rights-of-way being
replatted with adjacent property and all utilities being relocated at the
applicant's expense. A satisfactory replat has been submitted.
