r .; ORDINANCE NO. ~~~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING A UTILITY EASEMENT LOCATED IN THE CHAPEL CREEK RANCH, PHASE 1-B, ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS AS MORE SPECIFICALLY DESCRIBED HEREIN; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECT ION 1 . THAT, proper arrangements for the relocation of existing telephone utility facilities having been made, the fifteen (15) foot by one hundred forty-four (144) foot utility easement lo- cated between Lots 40 and 41, Block 16 of the Chapel Creek Ranch, Phase 1-B, Addition to the City of Fort Worth, Tarrant County, Texas, the plat of which is recorded in Volume 388-211, Page 97, Plat Records Tarrant County, Texas, be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. T hat all ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 3. T hat this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. (V-88-43) RECOMMENDATION It is recommended that the City Council adopt an ordinance vacating 15' by 144' long utility easement, located between Lots 40 and 41, Block 16, Chapel Creek Ranch, Phase 1-B, as recorded in Volume 388-211, Page 97, P.R.T.C.T. DISCUSSION Chapel C.r_eek Joint Venture, owners of all abutting property has requested that the-City vacate the above described utility easement, as shown on the attaehed-map. The^sub~ject easement, acquired by dedication, is platted and contains a fel.ephone utility facility. Satisfactory arrangements have been made with the-uti-lity company to relocate the telephone cables. The subject vacation -- i-s-ma`de~ i n order to uti 1 i ze the vacated easements as part of the development of the subject property. The Director of Real Property Management has determined that a $1.00 consideration fee satisfies the City of Fort Worth's interest in this request. Reviewing City departments and private utility companies have raised no objection to this request.
