HomeMy WebLinkAboutOrdinance 10394-~ t%"`= ~,, x ,(~ _~ D~J ~_T ORDINANCE N O AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS IN THE GENERAL FUND, FUND O1, POLICE SPECIAL INVESTIGATIONS DIVISION ACCOUNT NO 35-42-00, OF THE CTTY OF FORT WORTH FOR FISCAL YEAR 1988-89 BY $4,390.00 AND APPROPRIATING SAID AMOUNT IN THE GENERAL FUND, POLICE DEPARTMENT, SPECIAL INVESTIGATIONS DIVISION ACCOUNT NO 35-42-00, FOR THE PURPOSE OF PURCHASING A FACSIMILE MACHINE TO INCREASE EFFECTIVENESS IN THE DISTRIBUTION OF TUVENILE RELATED MATERIALS BETWEEN THE YOUTH SECTION AND THE JUVENILE PROBATION DEPARTMENT, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1988-89 and in the Budget of the City Manager, there shall also be increased estimated receipts of $4,390 00 in the General Fund, Fund O1, Police Special Investigations Division Account 35-42-00, thereby increasing appropriations by $4,390 00 for the purpose of purchasing a facsimile machine to increase effectiveness in the distribution of juvenile related materials between the Youth Section and the Juvenile Probation Department SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 10151 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and effective date into the minutes of the City Council and by filing this ordinance in the ordinance records of the City of Fort Worth. SECTION 5 This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Accept in the General Fund O1 $4,390 from earned income from recoveries ---•-• -- of drug related cash and equipment, and ~y_ 2. Adopt the attached supplemental appropriations ordinance increasing estimated receipts by $4,390 in General Fund O1 and appropriations by the same amount in General Fund O1, Police Special Investigations Division Account No. 35-42-00 from increased revenues. BACKGROUND. The Youth Section of the Special Investigations Division is experiencing problems processing juvenile cases resulting from reductions in the size of the unit in previous budgets. Currently, Fort Worth is the only major municipality which does not have a fully functional twenty-four hour per day, seven day a week Youth Section. As a result Fort Worth is presently the only agency allowed to register juvenile offenders into the Tarrant County Juvenile Detention facility prior to formal charges being filed. The Tarrant County Juvenile Boards' policy is that when a youth is detained a petition must be filed by the District Attorney's office by the third day after the detention hearing. Large numbers of youth are sent to the Detention Center whose cases are subsequently police disposed, or where cases are handled as many as three times then police disposed. Primarily, the biggest concern of the Youth Section and the Juvenile Probation Department is the amount of time between the arrest of a juvenile offender and when the Juvenile Probation Department receive a copy of the offense report, a copy of the case file, or disposition sheet. In reviewing alternatives to resolve their problems, the Youth Section tested a facsimile machine to determine its effectiveness in the di~stribut`on'of juvenile related materials between the two agencies. With=a'~f,acsim'le";machine the lag time in filing juvenile cases would' he reduced by `three (3) working days, the Juvenile Probation Department could receive intake reports in a timely manner reducing the amount of time researching inquiries and the Youth Section could immediately verify missing youths and adults that are runaway or wanted by outside agencies. In addition, it, would reduce the amount of time spent manually transporting documents betweenlthe two agencies.
