ORDINANCE N0.
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING TWO UTILITY EASEMENTS LOCATED IN THE FOREST
HIGHLANDS ADDITION TO THE CITY OF FORT WORTH, TEXAS, SAID
EASEMENTS BEING MORE SPECIFICALLY DESCRIBED HEREIN; RE-
PEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the five (5) foot by one hundred eighty-five (185) foot
utility easement and the ten (10).foot by one hundred forty (140)
foot utility easements, both more particularly described in
Exhibit "A" attached hereto and incorporated herein by reference for
all purposes, and both being located in Lot C, Block 5 of the Forest
Hig hlands Addition to the City of Fort Worth, Texas, the plat of
which is recorded in Volume 388-45, Page 96 of the Plat Records of
Tarrant County, Texas, be and the same are vacated, abandoned and
permanently closed and exting uished.
SECTION 2.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.

That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

A portion of Lot C in Block 52 of Forest Highlands, an Addition
in the City of Fort Worth in Tarrant County, Texas as said Lot
appears upon the map recorded in volume 388-45, page 96 of the
Tarrant County Deed Records.
Beginning at the southwest corner of said Lot C.
Thence north no degrees-49 minutes west, along the west line of
said Lot C, a distance of 185 feet.
Thence north 89 ~~. :a~-,..'~ minutes east, along the north terminus
of a 5 feet r~~_de utility easement 5 feet.
Thence south no degrees-49 minutes east, along the east line of
said 5 feet wide utility easement 105 feet to the north line of a
10 feet wide utility easement.
Thence north 89 degrees-11 minutes east, along the said north
line of the 10 feet wide utility easement, 140 feet.
Thence south no degrees-49 minutes east, 10 feet to the south
line of the said 10 feet wide utility easement.
Thence south 89 degrees-11 minutes west, along the said south
line of the 10 feet wide utility easement, 140 feet to the said
east line of the 5 feet wide utility easement.
Thence south no degrees-49 minutes east, along the said east line
of the 5 feet wide utility easement, 70 feet to the south line of
said Lot C.
Thence south 89 degrees-11 minutes west, along the said south
line of Lot C, a distance of 5 feet to the place of beginning and
containing 2,325 square feet.

RECOMMENDATION
It is recommended that the City Council adopt an ordinance vacating a 5' X
185' and a 10' X 140' utility easement, located iri Lot C, Block 5, Forest
Highlands Add itiori, as recorded in Volume 388-45, Page 96, P R T.C T

Mr John B McClane, attorney, representing Dr John W. Freese, owner of all
abutting property, has requested that the City vacate the above described
utility easement , as shown on the attached map
The subject easement, acquired by dedication, is platted but does not contain
any utility facilities The subject vacation is made in order to utilize the
vacated easement as part of the development of the subject property.
The Director of Real Property Mariagemerit has determined that a $1 00
corisideratiori fee satisfies the City of Fort Worth's interest in this
request
Reviewing City departments and private utility companies have raised no
objection to this request
