ORDINANCE N0.~1~~
AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN-
GUISHING A UTILITY EASEMENT LOCATED IN THE NIES AND ROUSE
ADDITION TO THE CITY OF FORT WORTH, TEXAS; SAID EASEMENT
BEING MORE SPECIFICALLY DESCRIBED HEREIN; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
THAT, proper arrangements having been made for the abandonment
and reclassification of existing sewer utility facilities having
been made, the utility easement located within Lot 5-R, Block 8 of
the Nies and Rouse Additio n to the City of Fort Worth, Texas, as
more specifically described in Exhibit "A" which is attached hereto
and incorporated herein by reference for all purposes, be and the
same is vacated, abandoned, and permanently closed and extinguished.
SECTION 2.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed,.
SECTION 3.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

EXHIBIT "A"
10.0 FOOT WIDE UTILITY EASEMENT
Being a tract of Land si=tuated in the Atkin McLemore Survey, Abstract X1056,
Tarrant Coun[y, Texas, and being a portion of Block 8, Nies and Rouse Addition
to the City of Fort Worth, as recorded in Volume 388-113, ,page 445, Deed Records,
Tarrant County, Texas, and being more particularly all that 10.0 foot wide Utility
Easement as depicted on said plat of Block 8 and being further described by metes
and bounds'as follows.
COMMENCING at a 1/2" iron pin found at the northeast corner of said Block 8;
THENCE South 00° - 12' - 00" East with the east boundary line of said Block 8,
same being the west right-of-way line of Grace Avenue, a public right-of-way
of 55 0 feet in width, 124.0 feet to a point in the north boundary line of said
easement for the point of beginning of the herein described tract;
THENCE South 00° - 12' - 00" East continuing with the east boundary line of said
Block 8, a distance of 10.0 feet to a point in the south boundary line of said
Easement,
THENCE West with said south boundary line, 231.11 feet to a point in the west
boundary line of said Block 8, same being the east right-of-way line of Sylvania
Avenue, a public right-of-way of varying width,
THENCE North 3° - 45' - 16" East with said west boundary line of Block 8, a
distance of 10.02 feet to a point in the north boundary line of said 10.0 foot
wide Utility Easement,
THENCE East with said north boundary line, 230.42 feet to the place of beginning
and containing 0.053 Acres of Land.

Recommendation
It is recommended that the City Council adopt an ordinance vacating a 10' wide
X 231.11' long utility easement, located in Lot 5-R, Block 8, Nies and Rouse
Addition, as recorded in Volume 388-113, Page 445, P.R.T.C.T.

Bruce Benner, project architect, on behalf of Lowell bushman, owner of the
subject property, has requested that the City vacate the above described
utility easement, as defined in Exhibit "A" and shown on the attached map.
The subject easement, acquired by dedication, is platted and contains sewer
utility facilities. The City Water Department has agreed to abandon these
facilities and reclassify the line as a service only facility. The subject
vacation request is made in order to utilize the vacated easement as part of an
expansion project on this site.
The Director of Real Property Management has determined that a $1.00 conside-
ration fee satisfies the City of Fort Worth's interest in this request.
Reviewing City departments and private utilities have raised no objection to
this request.
