HomeMy WebLinkAboutOrdinance 18866-10-2009ORDINANCE NO. 18866-10-2009 AN ORDINANCE AMENDING THE CODE OF THE CITY OF FORT WORTH, TEXAS, (1986), AS AMENDED, TO ESTABLISH A NEW PARKING METER RATE NO. 2 -TWO HOUR RATE BY AMENDING SUBSECTION (d)(2) OF SECTION 22-191, "ESTABLISHMENT OF ZONES AND MAXIMUM PARKING TIME THEREIN; ESTABLISHMENT OF FEES," DIVISION 2, "PARKING METERS," ARTICLE VI, "STOPPING, STANDING AND PARKING," CHAPTER 22, "MOTOR VEHICLES;" PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. Subsection (d)(2) of Section 22-191, "Establishment of Zones and Maximum Parking Time Therein; Establishment of Fees," Division 2, "Parking Meters," Article VI, "Stopping, Standing and Parking," Chapter 22, "Motor Vehicles" shall be and read: Parking Meter Rate No. 2 -Two-hour parking: Two (2) minutes and twenty four (24) seconds for each five cent ($0.05) coin deposited in the meter; four (4) minutes and forty eight seconds for each ten cent ($0.10) coin deposited in the meter; and twelve (12) minutes for each twenty-five cent ($0.25) coin deposited in the meter. SECTION 2. This ordinance shall be cumulative of all provisions of ordinances of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, para~-aph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid jud~nent or decree of any court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not effect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. DISCUSSION: The approval of the Fiscal Year 2009-2010 budget on September 15, 2009, by the City Council authorized an increase to the City of Fort Worth's Parking Meter Rate No. 2 -two hour rate. This rate change will effectively improve parking turns leading to better parking space utilization and result in a revenue increase of approximately $200,000.00 annually. With this change, the Parking Meter Rate No. 2 -two hour rate is brought closer to the average rate for short term parking in the Central Business District of the two most populous Cities in Texas of $1.375 per hour; while the current cost of parking on a two hour metered space in Fort Worth is $1.00 per hour. With an increase of $0.25 per hour the hourly cost for a two hour metered space will be $1.25. The adoption of the ordinance amending Section 22-191(d)(2) of Chapter 22 "Motor Vehicle and Traffic" of the City Code is necessary before implementing the new rates. Section 22-191(d)(2) currently reads: Parking Meter Rate No. 2 -Two hour rate: three minutes for each ($0.05) coin deposited in the meter; six minutes for each ten cent coin deposited in the meter; and fifteen minutes for each ($0.25) coin deposited in the meter. Upon adoption of the attached ordinance, Section 22-191(d)(2) will read: Parking Meter Rate No. 2 -two hour parking: two minutes and (24) seconds for each five cent coin deposited in the meter; four minutes and (48) seconds for each ten cent coin deposited in the meter; and (12) minutes for each ($0.25) coin deposited in the meter. With this change, the Parking Meter Rate No. 2 -two hour rate, will bring the short term parking rate in Fort Worth closer but not equal to the average rate currently in place in the Central Business District of the two most populous Cities in Texas.
