That, subject to the existing telephone and electric utility facilities being relocated, the utility easement described more specifically in two sections as Easement "A" and Easement "B" on Exhibit "A", which is attached hereto and incorporated hereby by reference for all purposes, be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. HAGAN HEIRS SUBDIVISION, 1 BLOCK 7,. LOTS 1-4, JACKSBORO HIGHWAY. ~ ~`~-_ It is recommended that the City Council adopt an ordinance vacating a 1478.47' long x 5' wide utility easement, located in Lots 1 through 4, Block 7, Hagan Heirs Subdivision, as recorded in Volume 388-57, Page 516, P.~.T.C.T. Discussion Brent Mizell, on behalf of the owner of the subject property, has requested that the City vacate the above-described utility easement, as defined in Exhi- bt Aand shown on the attached map. The subject easement, acquired by dedication, is platted and contains telephone and electric utility facilities. Satisfactory arrangements have been made for relocation of said existing utility facilities. The subject vacation is made in order to utilize the vacated easement as part of the development of the subject property . Director of Real Property Management has determined that a $1.00 consideration fee satisfies the City of Fort Worth's interest in this request. Reviewing City departments and private utility companies have raised no objec- tion to this request, subject to any utility facilities being relocated at the appl icant's expense.
