BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXA5:
SECTION 1.
That, subject to the existing telephone and electric utility
facilities being relocated, the utility easement described more
specifically in two sections as Easement "A" and Easement "B" on
Exhibit "A", which is attached hereto and incorporated hereby by
reference for all purposes, be and the same is vacated, abandoned
and permanently closed and extinguished.
SECTION 2.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 3.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

Two {2) 5.00 Foot Wide Utility Easements To Be Vacated
Easement '"A"
Being a 5.00 foot wide utility easement along the south and east lines
of Lot 4, Block 7, HAGAIJ HEIRS SUBDIVISION to the City of Fort
Worth, Tarrant County, Texas, as recorded in Volume 3138-57, Page
516, Tarrant County Plat Records, the centerline of said 5.00
foot wide easement being more particularly described as follows:
Beginning at a point in the west lane ofsaid Iot 4 said point
being N 00°09'38" W 2.50 feet from the southwest corner of said
Lot 4;
THENCE N 89°54'26" E, ,parallel to and 2.50 feet NORTH of the
south line of said Lot 4, ,a distance of 386.17 feet;
TFiE~NCE NORTH, parallel td and 2.5'0 feet WEST of the east line
of said Lot 4; a distance of 712.90 feet to a ,point in the south
line of Jacksboro Highi~ay ~ Stave Highway Ito. 1`99 } and the end
of the herein described centerline.
Easement "B"
Being a 5.00 foot wide utility easement along the north lines
of Lots 1, 2 and 3, Block 4, and the east line of said Lot 1,
Block 4, HAGAN HEIRS SUBDIVISION to the City of Fort Worth, Tarrant
County, Texas, as recorded in Volume 388-17 Page 151, Tarrant
County Plat Records,the centerline of said 5.00 foot wide easement
being more particularly described as follows:
Beginning at a point in the west line of said Lot 3, said point
being S 00°03'47" E, 2.50 feet from the northwest corner of said
Lot 3;
THENCE N 89°54'2b" E, parallel to and 2.50 feet SOUTH of the
north line of said Lots 3.,2 and 1, a distance of 221.68 feet;
THENCE SOUTH, parallel. to and 2.50 feet WEST of the east line
of said Lot 1, a distance of 1.57.72 feet to a point in the north
line of Ohio Garden Road and the end of the herein described
centerline.

Recommendation

BLOCK 7,. LOTS 1-4, JACKSBORO HIGHWAY. ~ ~`~-_
It is recommended that the City Council adopt an ordinance vacating a 1478.47'
long x 5' wide utility easement, located in Lots 1 through 4, Block 7, Hagan
Heirs Subdivision, as recorded in Volume 388-57, Page 516, P.~.T.C.T.
Discussion
Brent Mizell, on behalf of the owner of the subject property, has requested
that the City vacate the above-described utility easement, as defined in Exhi-
bt Aand shown on the attached map.
The subject easement, acquired by dedication, is platted and contains telephone
and electric utility facilities. Satisfactory arrangements have been made for
relocation of said existing utility facilities. The subject vacation is made in
order to utilize the vacated easement as part of the development of the subject
property .
Director of Real Property Management has determined that a $1.00 consideration
fee satisfies the City of Fort Worth's interest in this request.
Reviewing City departments and private utility companies have raised no objec-
tion to this request, subject to any utility facilities being relocated at the
appl icant's expense.
