AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS IN THE GENERAL FUND, FUND O1, POLICE
DEPARTMENT, INDEX CODE 055012, MISCELLANEOUS INCOME, OF THE CITY OF FORT WORTH FOR
~ FISCAL YEAR 1988-89 BY $24,033 AND APPROPRIATING SAID AMOUNT TO THE GENERAL FUND, POLICE
' DEPARTMENT, AUTO POUND, ACCOUNT NO 35-55-01, FOR THE PURPOSE OF CONTRACTING WITH AN
OUTSIDE VENDOR TO REMOVE CHEMICALS, CONFISCATED FROM ILLEGAL DRUG LABORATORIES, FROM
THE AUTO POUND., PROVIDING FOR A SEVERABII,TTY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE
~ OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, PROVIDING
' FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS'
SECTION 1.
That in addition to those amount s allocated to the various City departments for the
Fiscal Year 1988-89 and in the Budget of the City Manager, there shall also be increased
estimated receipts of $24,033 in the Gene ral Fund, Fund O1, Index Code 0 55012, Miscellaneous
Income, and appropriating said amount thereby increasing appropriations by $24,033 to the
General Fun d, Police Department, Auto Pound, Account No 35-55-01 for the purpose of
contracting with an outside vendor to remove chemicals, confiscated from illegal drug
laboratories, from the Auto Pound
SECTION 2
Should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision,
opinion or judgement shall in no way impair the remaining portions, sections, or parts of
sections of this ordinance, which said remaining provisions shall be and remain in full
force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No 10151 and all other
ordinances and appropriations amending the same except in those instances where the
provisions of this ordinance are in direct conflict with such other ordinances and
appropriations, in which instance said conflicting provisions of said prior ordinances and
appropriations are hereby expressly repealed.
SECTION 4.
The City Secretary of the City of Fort Worth is hereby directed to engross and enroll
this ordinance by copying the caption and effective date into the minutes of the City
Council and by filing this ordinance in the ordinance records of the City of Fort Worth.
SECTION 5.
This ordinance shall take effect and be in full force and effect from and after the
date of its passage, and it is so ordained.

RECOMMENDATION
It is recommended that the City Council
1) Increase estimated receipts in the amount of $24,033 from income earned
from restitution payments, sales and auctions, refunds and recoveries of
drug related cash and equipment, to be deposited in General Fund Ol,
Index Code 055012, Miscellaneous Income.
2) Adopt attached supplemental appropriation ordinance increasing
appropriations in General Fund O1, Police Department, Auto Pound Account
No 35-55-01 from increased receipts, and
3) Authorize the use of $24,033 to contract with an outside vendor to
remove chemicals confiscated from illegal drug laboratories located at
the Police Auto Pound
DISCUSSION
For the past several years, the Police Department has faced the ever-mounting
problem of dealing with illegal drug laboratories The chemicals confiscated
from these operations have been stored in five gallon plastic buckets at the
Police Auto Pound, in the open Between 400-500 gallons of these chemicals
have accumulated Several instances of leakage and theft by fence cutting
have occurred
Plans are being formulated at this time for future transportation, storage,
and disposal of these chemicals properly However, the present situation
makes immediate disposal of chemicals already stored at the Auto Pound
expedient
Bids have been received from four vendors for the removal of these chemicals
The one complete bid which meets disposal requirements is from Leak-Tec
Corporation, for $15,033 for chemicals on hand as of August 1, 1988
Additional chemicals have accumulated, for a complete cost of $24,033, as of
October 4, 1988
FINANCING
Sufficient funds are available in the General Fund O1 from deposits of monies
received from restitution payments, sales and auctions and refunds and
recoveries of drug related cash and equipment in the amount of $24,033 00 for
the adoption of the above supplemental appropriation ordinance
Expenditures will be made from Index Code 266221
