'" . ~?~ ORDINANCE NO. ~,~~~~ AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING AN EAST/WEST ALLEY AND A FIFTY (50) FOOT BY ONE HUNDRED THIRTY-TWO (132) FOOT PORTION OF LITTLE STREET IN THE CITY OF FORT WORTH, TEXAS, AS MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING FOR REVERSION OF FEE IN SAID LAND(S); REPEALING ORDINANCE NO. 10124 AND ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT, the east/west alley, more specifically described in Exhibit "A" which is attached hereto and incorporated herein by reference for all purposes, located between Crenshaw Street on the north and Fitzhugh Avenue on the south as it runs from Bishop Street, east, to Campbell Street, all within the City of Fort Worth, Texas, and the fifty (50) foot by one hundred thirty-two (132) foot portion of Little Street as it runs from the aforementioned alley south to Fitzhugh Avenue, also within the City of Fort Worth, Texas, be and the same is vacated, abandoned, and permanently closed and extinguished. SECTION 2. That the fee to the land(s) in the above described vacated public alley and right-of-way and public street and right-of-way is hereby released and shall revert to the adjacent owner(s) as pro- vided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities and all existing and prospective drainage requirements as necessary. ,,,~'' 4, ~ ~, , SECTION 3. That Ordinance No. 10124, adopted on June 7, 1988, and all other ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. Ramey Survey, Abstract No. 1342, Fort Worth, Tarrant County, Texas, and being more particularly described as follows: BEGINNING at the southwest corner of Lot 3, Block 23 of the Englewood Heights Addition as recorded in Volume 310, Page 67 of the Tarrant County Plat Records on the north line of a 15 foot public alley; THENCE, East along the north line of said alley a distance of 138.00 feet for a corner; THENCE, South a distance of 7.5 feet for a corner; THENCE, East along the north line of a 7.5 foot public alley a distance of 814.45 feet to a point in the west right-of-way line of Campbell Street (a 50 foot wide public right-of-way); k THENCE, South along said west right-of-way line a distance of 7.5 feet to a point in the south line of said alley; THENCE, west along said south line a distance of 952.45 feet to a ~ inch steel rod for the northeast corner of Lot 13, Block 23 of said Englewood Heights Addition; THENCE, North a distance of 15.00 feet to the POINT OF BEGINNING, and embracing 8187 square feet or 0.188 acres of land. DISCUSSION: On June, 7, 1988 the City Council adopted Ordinance No. 10124, vacating a 15' X 957' east/west alley within the above described platted properties. In preparation of final plats for filing with the County Clerk, it was discovered that the description contained within the ordinance was in error and that it would be necessary to rescind Ordinance No. 10124 and adopt anew ordinance accurately defining the street and alley to be vacated as described above. i Daniel P. McPeod, with Everage, Smith, & Farrington, representing the Fort Worth Independent School District, owner of all abutting property, had originally requested to the City to vacate the above described street and alley right-of-way as shown on the attached map. The subject alley right-of-way, acquired by dedication, presently contains sewer and electric utility facilities. The utility service providers have agreed to vacate the subject alley right-of-way in lieu of the dedication on the plat of a utility easement. The subject street does not contain any utility facilities. The subject vacation request made in order to replat the vacated alley and street right-of-way with adjacent property, to construct the McRae Elementary School. The land agent for the City of Fort Worth has determined that no monetary consideration for the vacation and transfer of this public right-of-way is necessary.
